NEERJA K. KALSON, J.
1. The prayer in the instant petition filed under Section 528 of BNSS, 2023 seeking quashing of FIR No.346, dated 29.10.2019, under Sections 341, 323 of IPC (Later on added Section 452, 509, 354 IPC), registered at Police Station Sadar Mansa, District Mansa along with all consequential proceedings arising therefrom on the basis of compromise dated 06.12.2025 (Annexure P-2) effected between the parties.
2. This Court vide order dated 23.12.2025 had directed the parties to appear before the Illaqa/Duty Magistrate to get their statements recorded and the learned Illaqa/Duty Magistrate was directed to send its report qua the genuineness of the compromise.
3. Pursuant to the aforesaid order, parties have appeared before PRIYANKA 2026.03.20 17:47 I attest to the accuracy and integrity of this document CRM-M-71601-2025 2 Additional Chief Judicial Magistrate, Mansa and got their statements recorded. On the basis of the statements so recorded, learned Additional Chief Judicial Magistrate, Mansa has submitted report dated 03.02.2026 to the effect that the compromise has been effected between the parties voluntarily and without any coercion or undue influence.
4. Learned State counsel as well as counsel for the private respondents have not disputed the factum of compromise between the parties.
5. In view of the fact that parties are known to each other being residents of the same village, the dispute arose between them when petitioner allegedly tried to molest respondent No.2, however, now the parties have amicably resolved their differences by deciding not to interfere in each other's lives and shall live peacefully, the continuation of the criminal proceedings would serve no purpose. The offences involved in the present case do not fall within the category of heinous offences having a serious impact on society at large. Rather the dispute appears to be purely private in nature, which has now been put to rest by the parties in shape of a compromise.
6. Accordingly, in view of the compromise effected between the parties and following the principles laid down by the Full Bench judgment of this Court in Kulwinder Singh and others Versus State of Punjab and another 2007 (3) RCR (Criminal) 1052 and Hon'ble Supreme Court in Gian Singh Versus State of Punjab and others (2012) 10 SCC 303, this Court is satisfied that it is a fit case warranting exercise of discretion under Section 482 Cr.P.C./ 528 of BNSS.
7. Consequently, the petition is allowed and FIR No.346, dated 29.10.2019, under Sections 341, 323 of IPC (Later on added Section 452, 509, 354 IPC), registered at Police Station Sadar Mansa, District Mansa PRIYANKA 2026.03.20 17:47 I attest to the accuracy and integrity of this document CRM-M-71601-2025 3 alongwith all the consequential proceedings arising therefrom, is hereby quashed qua the petitioner on the basis of compromise between the parties.
