ORDER 

The present petitioner ? convict prisoner preferred an application through jail to release him on parole for construction of the house as well as to provide financial help to the family members before the District Magistrate, Baroda, and ld.District Magistrate by his order dated 30.06.2008 rejected the said application. Hence, the present application is preferred before this Court.

As per the jail report, he was convicted for the offences punishable under section 457, 394, 459 and 114 of the IPC, and he was awarded sentence of 4 years. He is in jail since last 2 years. As far as other case is concerned, he is acquitted by the Court.

Heard.

In view of the above, the District Magistrate, Baroda is ordered to reconsider the application of the convict prisoner and verify as to whether he was released in past by the Court or by competent authority or not, and thereafter pass order in accordance with law, without being influenced by the order passed by this Court preferably within two weeks from the date of receipt of this order. The application stands disposed of.
