% 21.07.2022 CRL.M.A. 13879/2022 (Application for exemtption from filing certified copy documents) 1.0 Exemption allowed, subject to just exceptions. CRL.M.C. 3296/2022, CRL.M.A. 13878/2022 & 13880/2022 2.0 This is a petition under Section 482 Cr.P.C read with Article 227 of the Constitution of India for quashing of the criminal complaint under Sections 138/142 of the Negotiable Instruments Act, 1881 bearing complaint case no. 9495/2020 pending before the Learned Chief Metropolitan Magistrate, Patiala House Court, New Delhi. 3.0 Learned counsel for the petitioner submits that now this matter has been assigned to Learned Metropolitan Magistrate, Patiala House Court (NI Act)-03, Rouse Avenue.
3.1 It is submitted that the petitioner has been arrayed as accused no. 3 in the said complaint on the premise that she is one of the Directors in control Signature Not Verified Digitally Signed By:GEETA JOSHI Signing Date:26.07.2022 11:20:37 of day to day affairs of the accused company. Whereas, the petitioner had nothing to do with the affairs of the company and actually it is her husband who looks after the affairs of the company and even the cheque in question was issued under his signatures. However, the petitioner has also been called upon to appear in the matter.
4.0 In view of the above, the petitioner is effectively challenging the summoning order. Petitioner has not filed the impugned order. 5.0 At this stage, learned counsel for the petitioner submits that she could not obtain copy of the impugned order as the matter got transferred from Patiala House Courts to Rouse Avenue.
6.0 Learned counsel requests for time for filing the impugned order. 7.0 List on 24.08.2022.
