Divatia, learned advocate for the petitioner seeks permission to withdraw the present petition with a liberty to take all the contentions / defences which may be available at the time of reassessment proceedings. Permission is accordingly granted. Present petition is dismissed as withdrawn with above liberty. However, it is clarified and observed that all the contentions / defences which may be available to the petitioner are kept open and which may be considered while determining the reassessment proceedings.
