Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Petitioner is one of the named accused in this case with allegation of causing some injuries by fire arms upon the informant. Submission is of false implication in a petty land dispute and petitioner is in custody since 10.12.2011 having no criminal antecedent.

If it is so, the petitioner is directed to be enlarged on bail on furnishing bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bettiah, West Champaran, in Srinagar P.S. Case no. 59 of 2011, subject to the conditions that the petitioner shall remain present before the court below on each and every date till disposal of the case. If the petitioner fails to remain present on two consecutive dates without any reasonable explanation the privilege granted shall be deemed to be cancelled.
