This case is taken up through video conferencing.
The present interlocutory application has been filed on behalf of the petitioner, seeking removal of defect(s) in terms with the order dated 20th August, 2020 passed by this Court.
Learned counsel for the petitioner submits that the office in its stamp reporting has pointed out the following defects:-
(i) The copy of the writ petition be served to respondent no.6;
(ii) Fresh copy of page nos.200 and 201 (corrected page nos.199-200) should be filed; and
(iii) Annexure-3 may be given by way of supplementary affidavit.
It is further submitted by the learned counsel for the petitioner that so far as the defect with regard to non-service of copy of the writ petition to the counsel for the respondent no.6 is concerned, it is submitted that the respondent no.6 is Steel Authority of India Limited, having its office at Ispat Bhawan, Lodi Road, New Delhi-110003, through one of its plants i.e. Bhilai Steel Plant at Bhilai, P.O. & P.S. Bhilai, District Durg (Chhattisgarh) and there is no retained counsel of the respondent no.6 available here to receive the copy of the writ petition and as such if this Court pleases so, a notice may be issued to the respondent no.6 So far as the defect with regard to providing true copies of page nos.200 & 201 (corrected page nos.199 & 200) is concerned, the -2- petitioner does not rely on the said documents and as such the said defect may be ignored.
So far as the defect with regard to Annexure-3 is concerned, the same is the only legible copy available with the petitioner and hence further time may be allowed to bring the legible copy of Annexure-3 on record.
Having heard learned counsel for the petitioner and learned A.C. to A.G. appearing on behalf of the respondent-State of Jharkhand, the defect nos.(i) and (ii) are ignored. So far as the defect regarding filing of legible copy of Annexure-3 is concerned, the same will be considered at the time of hearing of the writ petition.
I.A. No.4526 of 2020 is, accordingly, disposed of.
