Heard on the question of admission and IA No.7161/2022, an
application for grant of ad-interim stay.
Let notice be issued to respondent No.2 only through trial Court
only. Notice shall be served by the trial Court either to the respondent (s) himself / herself or to the counsel appearing for him / her, in order to facilitate expeditious disposal of the appeal.
On payment of Process Fee (PF) within a period of one week, Office is also directed to handover notice to the counsel for the appellant
(s), who shall deliver the notice to the trial Court for its service to the respondent (s) by the trial Court, as aforesaid. Notice be made returnable within three weeks.
Let notice be also issued to respondent No.1 by both modes on payment of PF within a period of one week.
Since a short point is involved in the petition, the matter may be heard finally on the next date of hearing itself.
Let the matter be listed on 6th December, 2022. Till the next date of hearing, the further proceedings of the trial Court shall remain stayed. C. c. as per rules.
