35. 1. This matter is taken up by video conferencing mode.

2. Mr. Parhi, learned Assistant Solicitor General of India for the Petitioners states that he has received the records from the previous counsel and prays for an adjournment as a last chance.

3. Mr. Mishra, learned counsel for the Opposite Parties-Caveators on the other hand points out that the Opposite Parties, many of whom have superannuated, are entitled to the same relief that has been granted regarding the implementation of the Flexible Complementing Scheme (FCS), which is a non-vacancy based in- situ promotion from one scale to the next higher scale, on the strength of the same relief has been granted to the other similarly placed. He places reliance on the judgment of the Supreme Court in State of Karnataka v. C. Lalitha, (2006) 2 SCC 747.

4. At the request of Mr. Parhi, learned Assistant Solicitor General of India, as a last chance, list on 15th September, 2021.

5. As the restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the parties may utilize a printout of the order available in the High Court's website, at par with certified copy, subject to attestation by the concerned advocate, in the manner prescribed vide Court's Notice No.4587, dated 25th March, 2020 as modified by Court's Notice No.4798, dated 15th April, 2021.
