We have heard the learned counsels for the applicant and the learned counsels for the respondents.
2. By this application, the applicants are claiming that the Overtime Allowance should be a part of wages. Learned counsel for the applicant submits that this issue had arisen in Writ Petition No.609/2011 before the Madras High Court and the Madras High Court held that the ordinary rate of wages means basic wages plus such allowances including the cash equivalent of the advantage accruing through the concessional sale to the workers of food grains and other articles, as the worker is for the time being entitled to, but does not include a bonus and wages for overtime work. Ordinary rate of wages means the basic wages plus such allowances as the worker is entitled to but does not include the bonus and wages for overtime work.
3. Learned counsel for the applicant further submits that the various Benches of this Tribunal relying on the judgment of Madras High Court have granted the relief to the employees subject to the decision of Supreme Court in pending SLP.

"3. It appears from the submissions of both learned counsels for the parties that this matter is no longer res integra in that the decision of the Madras High Court in this matter dated 30.11.2015, (Annexure A-5), has been followed in a number of judgments subsequently passed in identical matters by CAT, Hyderabad in OA No. 1372/2012 order dated 04.04.2015, CAT, Principal Bench, in OA 650/2016 order dated 25.04.2018, CAT Kolkata Bench in OA No.350/705 of 2020 order dated 11.11.2020, CAT Kolkata Bench in OA No.350/00260 of 2021 dated 24.02.2021 and CAT Kolkata Bench in MA No.350//425 of 2021 in OA No.350/355 of 2021 order dated 20.03.2021.
4, In the aforementioned circumstances, we deem it appropriate to dispose of this OA by directing the respondents to allow the applicants such benefits by way of para 8 of the OA (para 8 of the OA Pg.No.11 refers), as are covered by the orders cited above.
5. Learned counsel for the respondents, Shri P.Khosla submits at this stage that the matter is now before the Hon'ble Supreme Court by way of SLP Nos.12845 to:
12852 of 2012; (para 4.5 of the OA refers), and that the applicant may therefore be asked to submit an undertaking to the effect that in the event of the Hon'ble Supreme Court allowing the SLPs in question, the benefit being allowed by this Tribunal vide this order will be recoverable. Ordered accordingly."
5. Learned counsel for the applicant further submits that other Benches of this Tribunal have also passed similar order. He further contends that the order of Principal Bench of this Tribunal was challenged before the Delhi High Court in Writ Petition (C) 51 OA No.547/2021 & 825/2022 No.10300/2018 decided on 28" September, 2018 in the matter of Union of India and others Vs. Employees Union Ordnance Factory Raipur Dehradun through its General Secretary and Anr. He submits that the Delhi High Court rejected the Writ Petition by making the following observation in para No.7 which is reproduced here for ready reference :
"7. In view of the above, we do not see any reason to differ with the view expressed in the impugned order particularly when the interest of the petitioners has been adequately secured as directions have been issued to release the benefits to the employees of the respondents/Union provisionally and payments released have been made subject to the outcome of the pending SLP's before the Supreme Court."
6. | Learned counsel for the respondents submits that the matters are pending before the Supreme Court, and therefore, no orders shall be passed till the decision of the Supreme Court.
7, Delhi High Court has held that the interest of petitioners has been adequately secured by giving directions to release the benefits to the employees subject to the outcome of the pending SLP's before the Supreme Court. We also deem it appropriate to follow the same course. We, therefore, direct the respondents to extend the benefits claimed in para 8 of the OA on condition that the applicants shall ey © =e 52 OA No.547/2021 & 825/2022 restore the benefits to the respondents in the event, the decision in SLPs pending in Supreme Court goes against them.
8. With these observations, we dispose of the OA. No costs.
