1. Heard Mr. D. Gogoi, learned counsel for the petitioner Sri Lalrinsanga. Also heard Mr. P. Borthakur, learned Add. P.P. for the State of Assam.

2. The petitioner has filed an application under Section 439 Cr.PC with prayer for bail as Page No.# 2/2 he is in custody since 05.04.2023 in connection with Bijni P.S. Case No. 51/2023 corresponding to the G.R. Case No. 100/2023 under Sections 420/489C/34 IPC.

3. The FIR unfolds that two boys were arguing and when they were apprehended fake currency was found in their possession and a bundle of white paper was also found which was to be used to be converted into fake currency notes. The petitioner was apprehended in relation to that incident.

4. I have considered the submissions at the bar that Section 489C is bailable offence. I have also considered the submissions that the petitioner is in jail since 05.04.2023. Investigation has presumably progressed to a considerable extent. It is also submitted on behalf of the petitioner that no case under section 420 IPC was made out.

5. In view of my foregoing discussions, petition is allowed. The petitioner is enlarged on bail of Rs. 30,000/- with a suitable surety of like amount to the satisfaction of the learned SDJM, Bijni under the condition that the petitioner will refrain from such activities with which he is alleged, failing which his bail will stand cancelled.
