ORAL ORDER
2 04-04-2023The present writ petition has been filed seeking the following relief:-
" That, this application is being filed for issuance of an appropriate writ/writs, commanding the respondent authorities to remove the encroachment made by the private respondent upon the land of Bihar Sarkar which is Anawad Sarvsadharan, Rasta under the khata no. 70, Plot No.180 an area about 04 decimal of village- Jogeyan,P.O.-Kajhai P.S.-Bikramganj, Anchal-Bikramganj Patna High Court CWJC No.10052 of 2016(2) dt.04-04-2023 2/2 District-Rohtas which is known and used as 'Rasta' of the passers of the village including the petitioner as the some portion obstructing to movers has been encroached by the private respondent and due to the said act, the petitioner as well the other persons of the village are facing all the trouble, which has also come in the knowledge of the authorities who on knowing all the fact are sitting tight over the matter and are not taking the suitable and firm step till date, resulting the petitioner and others user of that path facing all the trouble regularly."
Considering the nature of prayer made in the present writ petition, I deem it fit and proper to grant liberty to the petitioner to approach the respondent authorities for redressal of his aforesaid grievances.
Accordingly, the writ petition stands disposed off on the aforesaid terms.
