JUDGMENT
The father of the appellant, viz.,Murigeppa Balappa Chiniwalar (since dead), was tried and convicted for offences punishable under Sections 7, 13(1)(d) read with Section 13(2) of Prevention of Corruption Act, 1988 (for short 'the Act) in Spl.Case (P.C.) No.3/1998 on the file of the Court of Special Judge, Belgaum. The impugned judgment was rendered on 29.9.2006. The accused died after the impugned judgment. The appellant, namely, Mahanthesh Murgeppa Chiniwalar, who is the son of deceased has preferred this appeal.
This Court by order dated 21.11.2006 has permitted the son of appellant to prosecute the appeal.

28. The accused was working as a First Division Assistant. He had to prepare the bills as per instructions of administrative head of the school only relating to such items which had been sanctioned by the Town Municipal Council (i.e. the management of School). The prosecution has not placed any material to prove that as on 3.4.1997 the Head Master of school had instructed the accused to prepare the bills regarding arrears of increments or salary. The prosecution has not produced any documents to prove that Town Municipal Council (management of the School) had sanctioned annual increments to accused or arrears of salary for the period of suspension.
29. It is also seen from records that accused was under suspension from 11.6.92 to 15.10.92. The Town Municipal Council by its resolution No.20393 dated 11.6.97 had resolved that period of suspension of PW. 1 shall be treated as on leave of whatever nature of leave that was available to the credit of PW. 1. On subsequent verification it 'a .4.
