ORDER
1. Today, Tribunal has considered the issue of solid as well as liquid waste management as monitored in terms of order of Hon'ble Supreme Court dated 02.09.2014 in Writ Petition No. 888/1996, Almitra H. Patel vs. Union of India & Ors., with regard to solid waste management and order dated 22.02.2017 in W.P. No. 375/2012, reported in (2017) 5 SCC 326, Paryavaran Suraksha vs. Union of India, with regard to liquid waste management in respect of State of Odisha.
2. After the previous order dated 27.01.2023, as many as three reports have been filed on 20.12.2023, 09.02.2024 and 12.02.2024.
3. Latest report dated 12.02.2024 discloses the information about solid and sewage waste management in tabulated form as under:-

All ULBs having Sewage Treatment Plants (STPs)/ Faecal Sludge Treatment Plants (FSTPs) have been instructed to utilise the treated waste water discharged from plant for sprinkling on the roads to mitigate the pollution due to dust and also for gardening purpose within the campus of the respective plants.
An estimated amount of 1141.42 crorehas been ring-fenced for implementation of sewage, septage& grey water management in the ULBs, through convergence of sources of fund such as SBM (Urban) 2.0 fund, 15th Finance Commission Tied Grant, 5th State Finance Commission Grant etc., SBM(Grameen) and the same is being utilised for the purpose.

A. Waste Processing Details:
For wet waste processing, 258 Micro Composting Centres(MCC) with a total capacity of 1,213.5 MT and for dry waste processing, 220 Material Recovery Facilities (MRF) with a total capacity of 2,260 MThave been established in 114 ULBs.
A total of 994.32 MT wet waste and 1,035.15 MT dry waste is processed in a day in above processing facilities.

(iii) Legacy Waste:
A. Remediation Details:
Out of 115 ULBs, 92 ULBs have Legacy Waste Dumpsites. 23 ULBs ( Keonjhargarh, Joda, Jajpur, Jagatsinghpur, Remuna, Soro, Chandabali, Hinjilicut, Dhamnagar, Boudhgarh, Junagarh, Nimapara, Kesinga, Pipili, Banki, Athgarh, Kamakshyanagar, Konark, Binika, Ranpur, Ganjam, Chikiti and G. Udaygiri) have no Legacy Waste Dumpsite. The total quantity of legacy waste in 92 ULBs is 46,87,982 MT. A total quantity of 4,41,397 MT legacy waste has already been partially remediated in 3 ULBs(Bhubaneswar,Rourkela and Barbil) and fully completed in 3 ULBs (Vyasanagar, Bellaguntha and Khariar Road).
Remediation of remaining quantity i.e.,42,46,585 MT are under process. Detailed information is mentioned in the table depicted below.

Sludge Treatment Plants (FSTPs) have been instructed to utilise the treated waste water discharged from plant for sprinkling on the roads to mitigate pollution due to dust and also for gardening purposes within the campus of the respective plants.

4. The data presented above reveals the following:
4.1 population-wise generation of Sewage, Grey water and Septage details with respect to ULBs in the State:17
1. In Towns with population between 1 lakh to 10 lakh, covering 9 ULBs, ranged between 114.67 - 20 MLD in respect of Bhubaneshwer, Cuttack, Sambalpur, Rourkela, Puri.
Grey Water generation ranged between 36.86-11.11 MLD in respect to Behrampur, Balasore, Baripada, Bhadrak etc. Septage generation ranged from 96-12 MLD in respect of Berhampur,Bhubaneshwar, Balasore, Cuttack, Baripada, Bhadrak, Rourkela, Puri.
2. In Town with population between 50,000 to 1 lakh covering 14 ULBs did not show any sewage generation whereas, grey water generation ranged between 10.15-5.21 MLD in respect of Balangir, Jharsiguda, Jeyopore, Baragarh, Brajarajnagar, Raygad, Bhowanipatna, Paradeep, Dhenkanal, Barbi, Keonghargarh, Jatari, Raygangapur, Sunabeda. Septage generation ranged from 26-14 KLD in Balangir, Sunabeda.
3. IN Town with population between 10,000 to 50,000 covering 87 ULBs did not show any sewage generation whereas, Grey water generation ranged from 5.06-1.10 MLD in respect of Byasanayar-Tasura.
4. In Towns with population below 10,000 covering 5 ULBS did not show any sewage generation whereas Grey water generation ranged from 1.00-0.72 MLD in respect of Kashinagar Khandapada, Tarbha, Gopalpur, Gudari. Septage generation ranged from 3.0-2.0 KLD in respect of Kashinagar, Khandapada, Tarbha, Gopalpur and Gudari.
4.2 Waste processing details with respect to ULBs show as follows:
1. In Town with population between 1 Lakh covering 9 ULBs have Total waste collection and Transported (wet and dry) is in the range of 384.58-36.36 MT/day; Total capacity of processing facilities established (MCC+MRF) is in the range of 390-28 MT and Total waste processed (wet + dry) is in range of 370.07- 26.00 which shows gap ranging from 84.25-0.28 MT/day.
2. In Towns having population between 50,000 to lakh covering 14 ULBs; Total waste collected & Transported in the range of 32.22-16.29 MT/day; Total capacity of processing facilities Established (MCC+MRF) is in the range of 60-15 MT/day and Total waste processed (wet & dray) is in the range of 30.0- 13.41 MT/day which shows gap ranging from 6.84-1.47 MT/day.
3. In Towns having population between 10,000 to 50,000 covering 87 ULBs.; Total waste collected & Transported in the range of 16.06-3.78 MT/day; Total capacity of processing facilities established (MCC+MRF) is in the range of 45-12 MT/day and Total waste processed (wet & dry) is in the range 18 of 16.06-3.78 MT/day which amounts for a gap ranging from 10.71-0.05 MT/day.
4. In towns having population below 10,000 covering 5 ULBs.;
Total waste collected & Transported in the range of 3.48-2.62 MT/day; Total capacity of processing facilities established (MCC+MRF) is in the range of 15-12 MT/day and Total waste processed (wet & dray) is in the range of 3.48-2.62 MT/day which amounts no gap existing.
4.3 Legacy Waste details with respect to ULBs show:
1. In towns having population between 1 lakh to 10 lakhs covering of 9 ULBs, Total Estimated Legacy waste is in the range of 19,43,802 MT - 31,724 MT, Total Remediated quantity is in the range of 1,73,686-1,46,690 MT and Total remaining legacy waste is in the range of 17,89,112- 31,724 MT.
2. In towns having population between 50,000 to 1 lakh covering 14 ULBs, Total Estimated Legacy waste is in the range of 79,556-116 MT, Total Remediated quantity is 13,600 MT and Total remaining legacy waste is in the range of 79,556-116 MT.
3. In towns having population between 10,000 to 50,000 covering 87 ULBs, Total Estimated Legacy waste is in the range of 82,200-1.089 MT, Total Remediated quantity is in the range of 72,000-7.187 MT and Total remaining legacy waste is in the range of 82,200-1.069 MT.
4. In towns having population below 10,000 covering 5 ULBs, Total Estimated Legacy waste is in the range of 3.612-336 MT, Total Remediated quantity is zero and Total remaining legacy waste is in the range of 3,612-336 MT.
5. Further, perusal of the above information reveals that in respect of Table 1 only the information relating to five Municipal Corporations concerning sewage generation which are sewered, has been disclosed and in respect of the other local bodies not having sewers, said information has not been disclosed on the pretext that they are based on septic tanks.
Chart-A reveals that there is Gap in Grey Water Treatment to the extent of 381.61 MLD.
196. A perusal of 4.2 chart reveals that total waste generated in 115 local bodies is 2,222.06 MT per day whereas treatment figure is disclosed to be 2019.47 MT and the gap of 202.59 exists. Comparing it with the previous position as recorded in the order dated 27.01.2023 as on 26.01.2023, the quantity of waste generated in the State was shown to be 2257 TPD and legacy waste was disclosed as 37.46 lakh MT. The legacy waste now disclosed is 46,87,982 MT is higher as compared with data furnished on 27.01.2023, that means in one year there is addition in the legacy waste.
In chart-4, sub-heading legacy waste, A is remediation details, we find that in column 4, remediated quantity (in MT) of many of the local bodies is disclosed as zero and the actual figures have not been given.
7. A time-bound plan to remediate legacy waste has been provided in chart B of IV giving the outer limit for remediation of legacy waste in 07 municipal corporations but in respect of the others, no time-line has been disclosed.
8. We have noticed following deficiencies requiring to be addressed in the next report;
(i) Out of Installed sewage treatment plants having capacity of 373.50 MLD, only 157.0 MLD is being actually treated thereby leaving a gap of 216.50 MLD with respect to five sewered cities. Household connectivity for complete utilization of treatment capacity has not been achieved and no timeline have been given. Performance results of 12 STPs has also not been disclosed particularly with reference to their compliance with fecal coliform.
(ii) Septage generation which is estimated to 1136 KLD and corresponding FSTP capacity installed is of 2087 KLD, the final septage utilization plan keeping public health hygiene into consideration has not been given.
(iii) There is a gap of 381.61 MLD in Grey Water Management and quality of grey water has not been disclosed. We have also taken on record the report of the Committee constituted by the Tribunal on 27.01.2023 (in para 34 of the order) filed on 14.07.2023 by Additional Secretary to Govt. of Odisha. According to the report of 20 the Committee, Grey Water Management has to comply to the "Tool Kit: Grey Water Management and IS 12314: Code of Practice for Sanitation with leading pits for Rural Communities and also as per IS 2470 (Part I and II) Code of Practice for installation of septic tanks, designs, criteria and constructions. Accordingly, the State should clarify on conformity to such codes and practices.
(iv) There has been variation in data furnished on Solid Waste Generation shown in 2023 and now. It is stated that data variation is on account of estimation and subsequently present data is based on weighment exercise.
(v) It has been disclosed that total waste being generated per day (2,222.06 TPD) is transported to processing sites and nothing is being landfilled. The processing facilities are in the form of compositing for wet waste and Material Recovery Facilities (MRF) for dry waste. But, fractionation analysis has not been disclosed giving quantities of compost produce and utilized and routing of components from MRFs through Authorized users.
(vi) In case of Legacy Waste, 42,46,585 MT is yet to be remediated which is lying in 89 ULBs. This status does not appear to tally with status of waste processing. Based on the statement given by the State Officials that remediation is being done Departmentally and hence, no longer timelines be granted for remediation of all sites.
(vii) Position with regard to ring-fenced account, has not been properly disclosed. A dedicated separate account was required to be opened.
