This letters patent appeal impugns an interlocutory order dated 24.07.2014 whereby the learned Single Judge admitted the writ petition filed by the respondent; ordered its listing for final hearing within six months and has also stayed the operation of the notices dated 11.03.2003 and 01.03.2009 (Annexures P-9 and P-11), respectively.

During the course of hearing, learned counsel for the respondent fairly states that if the writ petition is ordered to be listed for final hearing on a specific date, he would not oppose the vacation of stay granted by the learned Single Judge.

In view of the above-stated fair stand taken by learned counsel for the respondent, we allow this appeal in part; modify the order dated 24.07.2014 passed by the learned Single Judge and while vacating the stay against operation of MOHINDER KUMAR 2014.12.09 16:02 I attest to the accuracy and authenticity of this document Chandigarh LPA No.1709 of 2014 (O&M) [2] the orders dated 11.03.2003 and 01.03.2009 (Annexures P-9 and P-11), respectively, the writ petition is directed to be listed out of turn for final hearing on 09.02.2015.
