The decree-holder/petitioner has come up with the grievance that the decree-holder/petitioner's application under Order XXI Rule 97 of the Code of Civil Procedure (Miscellaneous Case No.316 of 2015) as well as the application of the judgment-debtor/opposite party under Section 47, read with Order XXI Rule 101 of the Code (Miscellaneous Case No.130 of 2016) have been kept pending for quite a long time.

In view of the nature of the order proposed to be passed, no prior service of notice on the opposite party is deemed necessary.

C.O. No.2334 of 2018 is disposed of by requesting the Judge, Third Bench, Small Causes Court at Calcutta to take up for hearing and dispose of Miscellaneous Case No.130 of 2016 as well as Miscellaneous Case No.316 of 2015, both pending in the said court in connection with Ejectment Execution Case No.75 of 2015, as expeditiously as possible, without granting any unnecessary adjournment to either side, preferably within December 31, 2018.

The petitioner will communicate this order to the court below as well as to the opposite party and/or learned advocate appearing for the opposite party in the court below at the earliest.

There will be no order as to costs.
