This Miscellaneous Application by the Revenue is directed against the order of ITAT dated 2.6.2017 pertaining to assessment year 2008-09.
2. At the outset it is noted that the Revenue seeks to withdraw the Miscellaneous Application. The Revenue has moved following application :-
"Sir/Madam, Sub: Request to allow withdrawal of pending appeal before ITAT vide ITA No. MA 82/M/21 in the case of M/s. JSW Energy Ltd. (PAN:
AAACJ8109N) A.Y. 2008-09 -reg.

2. With reference to the above captioned subject, it is submitted that this office has filed Miscellaneous Application on 18.03.2021 against the MA filed by the assessee bearing MA No.829/Mum/2017 arising out of ITA No. 1334/Mum/2015 dated 10.07.2019 in the case of M/s. JSW Energy Ltd.
(PAN: AAACJ8109N) for A.Y. 2008-09. In this regard, this office withdraws the MA filed on 18.03.2021 on approval of Pr. CIT Central-4, Mumbai. Copy of approval letter issued by the Pr.CIT (C)-4 Mumbai is enclosed herewith."

3. Upon careful consideration we have granted permission to withdraw the Miscellaneous Application. Accordingly, this Miscellaneous Application is dismissed as withdrawn.
