Recruitment Rally for selection of Soldiers (GD) was conducted by respondent No.3. A news item pertaining to this was published in the `Dainik Bhaskar'. The petitioner who was son of an Ex- serviceman applied for taking part in the recruitment rally conducted by respondent No.3 on 7.6.2007.
It is the case of the petitioner that he was declared successful in the physical test and his medical test was also conducted in which also he was declared pass. The petitioner was allotted No.0163 and was called for the written test. However, the petitioner secured 145 marks i.e. less than the last selected candidate in the General Category. It has been averred by the petitioner that since he was the dependent of the ex-serviceman, hence he should be considered in the category of `Son of Ex-serviceman (SOEX)' and [ 2 ] C.W.P. No. 18868 of 2007 be selected as Soldier.
Reply has been filed on behalf of the respondents wherein it has been averred that the petitioner could not produce any document to show that he was the son of an ex-serviceman and, hence, the case of the petitioner was considered in the General Category. It has also been averred by the respondents that the cut off marks for being selected in the General Category were 146 whereas the petitioner had secured 145 marks and, hence, he was not considered for appointment as a Soldier (GD). Counsel for the respondents further submits that now the recruitment process is over and that the petitioner may apply in the next rally along with the relevant certificates/documents as and when the same is held.
In view of the aforementioned facts, it is clear that the petitioner did not produce the documents relating to the category of `Sons of Ex-serviceman' and in the General Category the petitioner had secured less marks than the last selected candidate, therefore, the petitioner has rightly been declined appointment as a Soldier.
No merit. Dismissed.
