Mr. Bhattacharya, learned advocate appearing for the petitioner submits that the petitioner has been falsely implicated. He married the de facto complainant in the year 2009. There is a pending matrimonial suit and the allegations levelled against the petitioner are absolutely unfounded and as such, custodial interrogation is not warranted.
He further submits that the petitioner would cooperate with the investigation and meet with the investigating officer as and when called for.
Mr. Begg, learned advocate appearing for the State and Mr. Bose learned advocate appearing for the de facto complainant oppose the petitioner's prayer.
Heard the learned advocates appearing for the respective parties. The petitioner is directed to meet with the investigating officer on 6th December, 2021 along with all relevant documents.
List this matter for further consideration under the heading "To 2 Be Mentioned" on 13th December, 2021.
In the meantime, the petitioner shall not be arrested. All parties shall act on the server copies of this order duly downloaded from the official website of this Court.
