CRIMINAL PETITION NOs.7248 7443 and 7453 of 2024
COMMON ORDER:-
since these criminal petitions are filed, under Section 482 of BNSS, seeking to grant antiCiPatOry bail, by the petitioners herein i`n same crime viz. crime No.208 of 2024 of Tadipathri Town Police station, Ananthapuram D'lstrict, registered for the OffenCeS Punishable under sections 147,148,188, 324 and 307 read with 149 lPC, they are being taken up together for disposal by way of this Common Order.
2. Case of{he prosecution, in brief, iS thatOn 14.05.2024, atabout 4:00 p.m., near the college ground on the Way tO New Municipal Office Road, Tadipatri, all the accused Criminally assembled unlawfully, armed with deadly weapons, and began hurling stones and sticks. During the incident, the defaCtO COmPlainant Sustained bleeding injuries to his nose. Due to political rivalry With the YSRCP leaders, the defaCtO comp!ainant feared for his safety and, as a result, did not report the matter to the police station directly. Instead, he sent a report through registered post.
3. Heard learned counsel for the petitioners and the learned Assistant Public Prosecutor representing the respondent/State. Perused the record.

A perusal of the material on record goes to show that the incI'dent in question iS -Said tO have OCCurred On 14.05.2024 and the petI'tiOnerS herein belonged to two leading political parties- one, the then ruling party, the other, the then opposition party. The incI'dent in question said to have taken place in connection vA-{h Assembly and Parliament EIectI'OnS held On 14.05.2024. In the present crime, the investI-ga{iOn Offl-Cer has recorded the Statements of material witnesses. As seen from the record, the crime was regI'Stered On 09.10.2024 and some of the victims have sent their grievances`{hrough registered post to the S.H.O. who registered three separate crI-meS. lt appears that based on the same incident different crimes have been regI'Stered. However, learned Assist'ant PublI-C Prosecutor submits that the victims are totally different. In the said facts of the case, the incident in question took place long back and therefore, thI'S Court finds that best part of investigation is over and any custodial interrogation does not Seem necessary.
5. Learned counsel for the petitioners submits that the petitioners had permanent abode and there is no possibility of their fleel'ng away from the justice and most of the petitI-OnerS are the breadwI'nnerS Of their families.

6. lt is evident+from the record that this Court has already granted interim protection to the petitioners, directing the State not to take any coercive steps against them, and the said order has been in force until today. It is not the case of the prosecution that the Petitioners have violated any of the .conditions imposed by the Court
7. ln view of the aforesaid facts and -circumstances of the Case, this Court finds that most of the investigation might haye been completed by this time and granting of anticipatory bail to the petitioners may not adversely affect the prosecution's case and hence, this Court is inclined {o grant anticipatory bail to the petitioners herein, however, On conditions.

Accordingly, in the event of their arrest in the above Said Crime, the petitioners hereI'n Shall be released On bail On executing a Personal bond for a sum of Rs.20,000/- (Rupees twenty thous.and Only) each with two sureties each for the like sum to the satisfaction of the arresting police officials and also on condition that the petitioners shall make themselves available for Investigation Officer as and when required and that they shall not cause any threat, inducement or promise to the prosecution witnesses. .
9. Accordingly, the Criminal Petition Nos.7248, 7400, 7443 and 7453 of 2024 are allowed.
