WRIT PETITION NO.2493 OF 2007
ORDER:
This writ petition is filed, seeking to direct the respondents to proceed further pursuant to the proceedings in Lr.No.E1/8655/2002, dated 26.10.2004 by the 1st respondent and Lr.No.D/1242/2004, dated 16.11.2004 and Lr.No.D/1242/2004, dated 20.3.2005 issued by the 2nd respondent and complete the process of allotment of house sites in accordance with law to the beneficiaries identified vide Lr.No.A3/839/99, dated 23.2.2000 by the respondents in the lay out approved by the 4th respondent vide permit No.5919, dated 28.9.2002 over an extent of Ac.4.00 cents in Sy.No.147 (P) of Kokapet Village, Rajendranagar Mandal.
2. The first petitioner is the society and petitioners 2 to 10 are claiming to be the members of the society. No blanket relief can be granted in favour of the society without knowing the particulars of the members of the society. Hence, the writ petition insofar as the first petitioner concerned is dismissed.

Insofar as petitioners 2 to 10 is concerned, the petitioners along with other individuals under the garb of the registered society filed an application before the respondents, seeking to consider their request for grant of house site pattas and accordingly, the respondents 1 to 3 have recommended their case and in the process of recommendation, time has elapsed and there is change in the circumstances and also in Government policy and it is the case of the Government that there is no land available for grant of house site pattas and their case can be considered for grant of 2 constructed houses like two bed room flats subject to their eligibility.

Since the recommendations were made way back in the year 2004 by the respondents in favour of the petitioners and in view of the change in administration and delimitation of the Mandal Revenue Offices, the petitioners are directed to file fresh applications before the respondents within a period of one months from the date of receipt of a copy of this order and the respondents shall consider their case in the light of the recommendations made earlier for the purpose of granting two bed room flats under the scheme of the Government as per their eligibility as expeditiously as possible. It is needless to observe that their case should be considered on the basis of equity as they are anticipating relief from the Government is pending since 1999 onwards.
4. Accordingly, the writ petition is disposed of. No order as to costs. As a sequel, the miscellaneous petitions pending if any shall stand closed.
