(1)Every entrance to mine from the surface, and the top and all entrances between the top and bottom, including the sump, if any, of every working, ventilating or pumping shaft, shall be kept securely fenced so designed and constructed as to prevent any person accidentally falling down the shaft or coming into contact with a moving part of the hoisting equipment provided in the shaft.
