"a) Grant leave to file this application jointly as provided under Rule 4(5)(a) of the Administrative Tribunal (Procedure) Rules1987;
(b) Quash the letter No.A-27017/1/2015-CHS-V (CHS- V section) dated 7th December, 2015 and letter No.A-27017/01/2014-CGHS-I dated 19.08.2014 passed by the respondents;
(c) Direct the respondents not to reduce the Transport Allowance @ Rs 7000/- + DA PM to the applicants, they being entitled to the same because they are drawing grade pay of Rs 10,000/-, in accordance with OM No. 21(2)/2008-E-II (B) dated 29.08.2008;
(d) Direct the respondents not to recover the alleged excess payment of the Transport Allowance @ Rs 7000/- + DA PM for any period from your applicants; and
(e) Pass such further order/orders which this Hon'ble Tribunal may deem fit and necessary in the interests of justice and direct the respondents to pay the cost of litigation to the applicants."
2. We have heard the Ld. Counsel for both the sides and have considered the material on record.
3. At hearing, Ld. Counsel for the applicant submitted that the applicants are Senior Administrative Grade (SAG) doctors of the Central Health Service(CHS) Cadre and work in different units such as Central Government Health Scheme (CGHS), All India Institute of Hygiene and Public Health (AIIH&PH), Port Health Organisation, Institute of Serology, Regional Leprosy Training Institute, etc. and that they are drawing pay in Pay Band- 4 with Grade Pay of Rs.10,000/- which is equivalent to the rank of Joint Secretary to the Government of India. Ld. Counsel for the applicant submitted that in terms of Government of India, Ministry of Finance OM dated 29.08.2008 , officers drawing grade pay of Rs.10,000/- and 12,000/- and those who are in the Higher Administrative Grade + scale are entitled to transport allowance@ Rs.7000/- + DA in case they do not use official vehicle. Date: 2025.02.28 17:02:30+05'30' Foxit PDF Reader Version: 2024.3.0 8 o.a. 350.00106.2016 circulated among all the units of CHS, transport allowance to the applicants have been restricted from Rs.7000/- plus DA, which they were drawing to Rs.3200/-
plus DA with immediate effect on the ground that SAG doctors were not equal to the level of joint Secretary to Government of India. He further submitted that this letter was issued without proper application of mind and only on the basis of some comments of the Audit Department. He further submitted that after the issue of the aforesaid letter, a spate of Original Applications were filed in various benches of this Tribunal, all over India challenging the same and that various benches of this Tribunal have stayed the operation of the aforesaid letter and stayed the recovery in respect of transport allowance. He cited the order of the Calcutta Bench of this Tribunal dated 18th January, 2016 and that the interim order was continued until further orders vide order dated 8/12/2017. Ld. Counsel for the applicants submitted that the rationale behind grant of transport allowance was to Compensate Government Employees for the expenses, they had incurred from commuting to work place from home and vice versa and that this was paid according to this scale of pay of the employees and was not linked to the rank of the employees.
4. Ld. Counsel for the applicant further submitted that during the pendency of this Original Application, the 7th Central Pay Commission had submitted its recommendations and that its recommendations pertaining to transport allowance have been accepted by the Government of India and that vide OM dated 15th March, 2018 transport allowance, at the rate of Rs.15,750/- plus DA has been sanctioned to officers who were considered to be eligible by their respective offices and who are who have also been offered the option to accept transport allowance in lieu of using official vehicle. Date: 2025.02.28 17:02:30+05'30' Foxit PDF Reader Version: 2024.3.0 9 o.a. 350.00106.2016 compliance of the instructions in the aforesaid OM, all the applicants in this O.A had submitted their options to their respective offices to the effect that they would accept transport allowance at the above rate and that after scrutiny of their options, the concerned authorities have found the applicants to be eligible for grant of transport allowance, at the rate of Rs.15,750/- plus DA.
5. At hearing, Ld. Counsel for the respondents submitted that the Principal Bench of this Tribunal in its Order dated 22.5.2014 in O.A No. 4062/2013 in the case of Radha Charan Shakiya and others held that similarly placed applicants who were granted the grade pay of Rs.10,000/per month in the Bank four or not entitled to transport allowance at the rate of Rs.7000/- per month plus DA thereon since transport allowance, at the rate of, 7000/- per month plus DA is applicable only to officers of the rank of joint secretary and not to the applicants merely on the ground that they draw the same grade pay as joint secretaries. Ld. counsel for the respondent further submitted that this order of the Tribunal was challenged in the Hon'ble High Court at Delhi in WP(C) No.3445/2014, but that the Hon'ble High Court of Delhi vide its order dated 13.9.20014, dismissed the said writ petition .

We find that during the pendency of this Original Application and following day in implementation of the recommendations of the 7th Central Pay Commission relating to grant of transport allowance to Central Government Employees , the Ministry of Health and Family Welfare(CHS), division vide their letter dated 15th March, 2018 addressed to all the participating units of CHS have informed that the request of CHS Officers to draw transport allowance@ Rs.15,750/- per month + DA thereon be forwarded to the ministry on a case to case basis for consideration of the competent authority. We have also taken note of the supplementary affidavit filed by Dr Amalendu Roy for and on behalf of all the applicants wherein he has affirmed that in compliance with the Ministry of Health letter dated 15th March, 2018 all the applicants in this Original Application, who are CHS Officers and who are drawing pay in Level-14, and above have submitted their options to draw transport allowance, at the rate of Rs.15,750/- per month plus DA thereon and that the said sale options have been forwarded to the Ministry of Health and Family Welfare by their respective units, confirming that all of them are entitled for using staff car and are therefore eligible for grant of transport allowance.
7. In view of the above discussion, we are of the opinion that the applicants are entitled to transport allowance, at the rate of Rs.15,750/- plus DA per month. From the submissions made by the Ld. Counsel during hearing, it appears that the Ministry of Health and Family Welfare has also accepted the claim of the applicants for grant of transport allowance, at the rate of Rs.15,750/- plus DA per month and that the grievance of the applicants in this Original Application in this regard has been resolved. This Tribunal, has vide its interim orders dated and has already restrained the respondents from making any recovery regarding over payment of transport allowance.
