In Re : An application under Section 482 of the Code of Criminal Procedure.
None appears on behalf of the petitioners or for the State.
The revisional application was preferred challenging the proceeding relating to a complaint under Sections 120B/500 of the Indian Penal Code and the petitioners approached this court immediately on receipt of the summons/notice.
Record of this revisional application reflects that prima facie after the learned Magistrate was satisfied in respect of the allegations made in the complaint and the initial deposition, process was issued against the accused persons.
The contentions advanced in this revisional application relate to question of facts, which cannot be agitated at the initial stage of the proceedings. 2 However, the record also reflects that there was no interim order for more than 9 years and the present stage of the proceedings before the learned Magistrate has not been apprised before this court.
Accordingly, no interference is called for by this court.
As such, the present revisional application being CRR 2392 of 2012 is dismissed.
All pending applications, if any, in connection with revisional application, are consequently disposed of.
Interim order, if any, is hereby vacated. All parties are to act on the server copy of this order duly downloaded from the official website of this court.
