FACTS
Vide RTI dt 18.6.12, appellant had sought information on 5 points relating to Shri PT Yolmo, ITO.
The RTI was transferred by CPIO Burdwan to CCIT Kolkata on 19.6.12 and further transferred to ACIT Siliguri on 27.6.12 and to ITO Ward-1, Darjeeling on 19.7.12.
3. An appeal was filed on 21.8.12 as no response was received.
4. AA/JCIT Range-2 Burdwan, vide order dt 14.9.12, disposed of the appeal stating that he was not the appropriate AA. Subsequently, AA/CIT Burdwan, vide order dt 17.10.12, informed the appellant that his appeal was filed before CIT Siliguri and disposed of the appeal.
5. Submissions made by the appellant and public authority were heard. Appellant submitted that he has not received a response from IT authorities till date. CPIO Darjeeling submitted that he had provided the information to JCIT Range-3, Siliguri vide letter dt 27.7.12 for onward transmission to the appellant. However, from the submissions made by Shri Aich, DCIT Siliguri, it seems that JCIT Range-3 authorised one of his officials to provide a response, which was never done.
DECISION
6. The Commission notes with concern and dismay the manner in which this RTI and the appeal of Shri Sadhu have been tossed around from one official to another with no individual taking responsibility for providing a response. The casual manner in which this RTI has been dealt with seems to indicate a total ignorance of the provisions of the RTI Act.
17. We direct Shri PT Yolmo, ITO Darjeeling/CPIO to provide an immediate response to the appellant.
The appeal is disposed of.
