ORDER 

 

  S.S. Nijjar, J.   
 

1. The petitioner has moved an application for grant of parole on the ground that he needs to cultivate his land. The respondents have admitted that the petitioner is owner of four acres of agricultural land. The parole has been denied to the pe-titioneron the ground that his sixteen year sold son would be able to do the necessary cultivation.

2. After hearing the learned counsel forthe parties, I am of the considered opinion that by giving such a reason the respondents are virtually denying the concession which have been granted to the petitioner by the appropriate authorities.

3. In view of the above, this petition is allowed. The respondents are directed to release the petitioner on parole for six weeks from the date of release, provided he is otherwise eligible under the rules and regulations, to the satisfaction of the District Magistrate, Karnal.

4. Petition stands disposed of.

5. Petition allowed.
