Section 49 in Adoption Regulations, 2017

49. Adoption of older children and siblings.

(1)Since it takes time for an older child to adjust with unrelated parents, it is important that the child and the prospective adoptive parents are made familiar to each other, before leaving the institution.
(2)Under the guidance of Specialized Adoption Agency or Authorized Foreign Adoption Agency, the prospective adoptive parents may have interactions with older children through video calls or by any other means, even before taking custody and the prospective adoptive parents may be encouraged to spend some quality time with the child before leaving the institution.
(3)The siblings and older children shall be deemed to be available for adoption by resident Indians and Non- Resident Indians (both the couple being Indian citizens) from the date they are declared legally free for adoption by the Child Welfare Committee and they shall be available for adoption by other categories of prospective adoptive parents after thirty days from the date they are declared legally free for adoption.Explanation. - For the purposes of this regulation, a child, who has completed five years of age, shall be considered as an older child.
