5. Alternative terms and conditions.
- 5.1 A Generating Company or Licensee, as the case may be, may agree to any terms and conditions that may vary from the terms and conditions contained in these Regulations where the terms and conditions agreed upon will result in a lower total cost of supply of electricity to consumers in the State during the entire duration of the agreement of which such terms and conditions form part:Provided that such agreement shall come into effect only with the previous approval of the Commission, except where such approval is not specifically required under the Act or these Regulations.
