ORDER (Oral)
SANJEEV KAUSHIK, MEMBER (J) The present Original Application has been filed for quashing of impugned seniority list of Inspectors of Customs & Central Excise, Chandigarh Zone, circulated on 23.4.2018 (Annexure A-10) being contrary to instructions and settled law. The second prayer of the applicants is to issue direction to the respondents to implement the decision rendered by this Tribunal in the case of Balwinder Singh Matharoo vs. Union of India & Ors, (O.A. No. 338/PB/2012), which has been upheld up to Hon'ble Supreme Court, whereby the seniority for the service rendered by applicants (therein) in the same cadre in the parent (previous) Commissionerate from the date of joining the Central Excise department and placing them in their corresponding batch year of direct recruitment on transfer basis has been granted.
2. Today, when the matter came up for hearing, Shri V.K. Sharma, learned counsel appearing on behalf of private respondents informs this Court that this O.A. has been rendered infructuous as the seniority list which the applicants have impugned in this O.A. has already been set aside by this Court in the case of Dhirendr Kumar Bhakta and Ors. vs Union of India & Ors.( O.A. No. 60/597/2018) decided on 5.2.2019. Thereafter, the official respondents have issued fresh seniority list on 29.3.2019 in consonance with the direction of this Tribunal in the above noted O.A. Thus, he submits that this O.A. be dismissed.
3. On the other hand, Shri D.S. Patwalia, learned Sr. Advocate appearing on behalf of applicants argues that the second prayer for implementation of decision in the case of Balwinder Singh Matharoo (supra) qua the applicants therein is also pending consideration as can 21 (OA No. 060/983/2018) be seen from the first seniority list where under clause 2(d), they have stated that the matter has been referred to Board for clarification for implementation of judgment in the case of Balwinder Singh Matharoo (supra) and it will be applicable to the applicants or in the case of all similarly situated persons. Thus, he submits that the present O.A. still survives in relation to second prayer. However, he submits that since the matter is pending before Board, therefore, this O.A. may be disposed of with a direction to respondents to take a decision on their claim in view of circular issued by the department to this effect.
4. Mr. Sanjay Goyal, learned CGSC, appearing on behalf of official respondents did not raise any objection to prayer made by the learned senior counsel for the applicants.

Considering the above factual scenario, the O.A. is dismissed as infructuous qua first relief, but regarding second relief, we direct the respondent no. 5 to pass order in terms of the circular issued by the department, whether the ratio as laid down in the case of Balwinder Singh Matharoo (supra) is to be applied to the applicants (therein only) or it is to be applied to all the similarly situated persons and while undertaking that exercise, they will also keep in mind the recommendations dated 3.8.2017 (Annexure A-14) made by the Govt. of India, Ministry of Finance to all Cadre Controlling Authorities under CBC. Let the above, direction be complied with, as expeditiously as possible, but not later than 3 months from the date of receipt of certified copy of this order. The O.A. stands disposed of accordingly with no order as to costs. Pending M.A. also stands disposed of as such.
