ORAL JUDGMENT
Date: 03-11-2015 Heard learned counsel for the parties.
Affidavits have been filed on behalf of the respondents taking the stand that admitted dues have been paid. However, the same is disputed by learned counsel for the petitioners who submit that there are still remaining dues to be paid.
In view of the aforesaid, the writ petitions stand disposed off with a direction to the respondents to file appropriate representation before the Chairman of the Bihar Power Holding Company Limited who shall transmit the same to the Competent Authority for consideration. If such a representation is filed within four weeks from today along with a copy of this order, the same shall be considered by the Competent Authority within the next four weeks. If any amount is found payable to the petitioner(s), the same shall also be paid to him/her within the next two weeks. It Patna High Court CWJC No.1477 of 2012 dt.03-11-2015 27/27 is made clear that if there is any grievance of the petitioners with regard to non payment of statutory interest on any head, the same shall also be redressed within the same period.
The payment of interest shall also be in terms of what the respondent Company has agreed in the Lok Adalat for making payments on such heads.
The Court would like to observe that if actual payments in terms of the affidavit and stand of the respondent Company have not been made to the petitioner(s), the same shall also be ensured within two weeks.
