New India Assurance Co. Ltd. And Another, (2000) 5 Supreme Court Cases 113, esa ekuuh; loksZPp U;k;ky; }kjk ;g fu/kkZfjr fd;k x;k gS fd%& "10. The question, therefore is, can a murder be an accident in any given case ? There is no doubt that "murder", as it is understood, in the common parlance is a felonious act where death is caused with intent and the perpetrators of that act normally have a motive against the victim for such killing. But there are also instances where murder can be by accident on a given set of facts. The difference between a // 10 // "murder" which is not an accident and a "murder" which is an accident, depends on the proximity of the cause of such murder. In our opinion, if the dominant intention of the Act of felony is to kill any particular person then such killing is not an accidental murder but is a murder simpliciter, while if the cause of murder or act of murder was originally not intended and the same was caused in furtherance of any other felonious act then such murder is an accidental murder. 18- N. Kabilan vs. New India Assurance Company Limited & Others 2015 (3) CPR 227 (NC) esa ekuuh; jk"Vªh; vk;ksx }kjk ;g fu/kkZfjr fd;k x;k gS fd%& "6. On bare reading of the above, it is clear that death benefit under the insurance policy is available to the legal heirs of the deceased insured only if the insured person dies as a direct result of injury sustained from an accident by external, violent and visible means. In the instant case, undisputedly, the deceased insured was murdered. This fact is evident from the copy of the judgment of Second Addl. Sessions Judge, Salem in the murder trial pertaining to the death of the insured wherein the late complainant M/s Jayalakshmi was charge-sheeted as one of the accused. On reading of the above judgment, it is clear that the insured Nagarajan was murdered by hitting him on his heading with a spade. Merely because the complainant was acquitted in the said trial by itself would not render the death due to murder into an accidental death. Since Nagarajan was murdered and did not die because of injury sustained // 11 // in an accident, his death is not covered under the insurance policy, which covers only the accidental death or the injury. Therefore, we do not find any infirmity in the impugned order of the State Commission which may call for interference by this Commission in exercise of revisional jurisdiction. Revision petition is, accordingly, dismissed with no order as to costs."

Sub Clause No. (p)- which states Act of terrorism: for the purpose of this exclusion, terrorism means an act or threat of violence or an act harmful to human life, tangible or intangible property or infrastructure with the intention or effect of influencing any government or putting the public or any section of the public in fear."
20- First Appeal No. 269/2015 M/s ATM Constructions Vs. United India Insurance Company Limited, Order Dated 19.04.2016 esa ekuuh; jk"Vªh; vk;ksx }kjk ;g fu/kkZfjr fd;k x;k gS fd%& // 12 // "5. ...... it was petitioner's own case throughout that the excavator had been destroyed by Naxalites in an attack on 19.12.2011. The destruction by Naxalites in my opinion, would certainly be an act committed by a commandeering group of malicious person, if it is assumed that they did not have any connection with a political organisation. Consequently, the aforesaid loss was not covered under the insurance policy taken by the petitioner......" 21- Muralidhar Sarangi vs. New India Assurance Co. Ltd. (2000) 3 Supreme Court Cases 466, esa ekuuh; loksZPp U;k;ky; }kjk ;g fu/kkZfjr fd;k x;k gS fd%& "8. Endorsement No. IMT 21, which has been reproduced above, consists of two distinct parts. The first part speaks of mutiny assuming the proportion of popular rising, military rising, rebellion, revolution, insurrection etc. The second part consists of :-
"Any act of any person acting on behalf of or in connection with any organization with activities directed towards the overthrow by force of the Government de jure or de facto or to the influence of it by terrorism or violence or by the direct or indirect consequence of the said occurrences."
13. When read in the light of the above statutory provisions as also the attending circumstances of this case, it becomes clear that provision
(b) of Endorsement No. IMT 21 of the insurance policies did not cover the risk complained of. The trucks were destroyed by acts of terrorism and a driver of the truck was also shot dead. The National // 13 // Commission was, therefore, fully justified in its conclusion that the respondent was not liable for the loss suffered by the appellant at the hands of Bodo activists who completely destroyed the trucks of the appellant by setting them on fire and killed one of the drivers." 22- In definition clause of Section 2 (k), (o) and (m) of The Unlawful Activities (Prevention) Act, 1967, it is mentioned thus :-
"(k) "terrorist act" has the meaning assigned to it in Section 15, and the expressions, "terrorism" and "terrorist" shall be construed accordingly;
(m) "terrorist organisation" means an organisation listed in the Schedule or an organization operating under the same name as an organisation so listed;
(o) Unlawful activity", in relation to an individual or association, means any action taken by such individual or association (whether by committing an act or by words, either spoken on written, or by signs or by visible representation or otherwise), -
(i) which is intended, or supports any claim, to bring about, or any ground whatsoever, the cession of a part of the territory of India or the secession of a part of the territory of India from the Union, or which incites any individual or group of individuals to bring about such cession or secession; or // 14 //

(iii) which causes or is intended to cause disaffection against India;
