CRM-2343-2018 Present application is filed under Section 482 Cr.P.C for issuance of appropriate directions to the trial Court to allow applicant- respondent No.2 to withdraw the criminal complaint dated 04.02.2014 (Annexure P-4).

It is contended by learned counsel for the applicant that the matter has been compromised between the parties and even an application dated 28.11.2017 (Annexure A-1) was also moved before the learned trial Court, but the same has not been accepted only on the ground that the matter is pending before this Court and more particularly the order dated 25.10.2017 passed in CRM-M-39736-2017.

Notice of the application to the counsel for non- applicant/petitioner.

Learned counsel for the non-applicant/petitioner states that he has no objection in case the present application is allowed.

In view of above, the present application is allowed and learned trial Court is directed to decide the application of the applicant- respondent No.2 without being influenced with regard to the pendency of CRM-M-39736-2017 before this Court and the same may be disposed of accordingly to law.

CRM stands disposed of accordingly.

CRM-M-39736-2017 In view of the above changed situation, learned counsel for the petitioner wishes to withdraw the present petition, at this stage.

Ordered accordingly.
