Appellant Shri N. Ramakrishnan
Public Authority Deptt.of HRI & WAKF
Date of hearing 26.08.2010
Date of decision 26.08.2010

Facts :-

The matter is called for hearing through video conferencing today dated 26.08.2010. Appellant not present. The Public Authority is represented by Shri U. Ilango, Manager (Temples).

2. It is noticed that the appellant had filed an RTI application dated 20.08.2009 requesting for information about the alienation of temple properties to the tenants and the matters related therewith. The CPIO had responded to it vide letter dated 18.9.2009 mentioning therein that information was yet to be received from respective temples and that it would be furnished to the appellant before 31.10.2009. This was followed by another letter dated 30.10.2009. The appellant had filed first appeal which was dismissed by the Appellate Authority on the technical ground of delayed filing.

3. In the appeal memo filed before the Commission, the appellant submits that the required information had been furnished to him after a lapse of 96 days. He also assails the dismissal of first appeal on a mere technicality.

4. As to the delay in furnishing information to the appellant, Shri Ilango submits that the information had to be collected from the concerned temples and the matter got delayed as the temples are not maintaining proper records.

DECISION

5. We are not fully satisfied with the delayed supply of information, even though we have taken note of the fact that the PIO was sending interim intimations to the appellant. The PIO is advised to be more punctilious in future. As the information has already been supplied, the appeal has become infructuous. Hence, the matter is closed.
