ORDER
1. The Tribunal in the previous proceedings had considered the report of the Joint Committee which had disclosed serious non-compliance. The Tribunal after taking note of the response of the Respondent No. 6- Jabalpur Municipal Corporation dated 22.09.2025 had made the following observation in the order dated 25.09.2025.
"7. The above report reveals that sincere and time-bound efforts are required by JMC to set up a proper drainage system and prevention of discharge of untreated sewage to the storm water drain. Immediate action is required in compliance of the direction of Hon'ble Supreme Court in the matter of Paryavaran Suraksha vs. Union of India in W.P. No. 375/2012, reported in (2017) 5 SCC 32, order dated 22.02.2017."
2. The Tribunal after considering the report of the JMC had issued the following directions:
"9. Considering the report of the JMC as extracted above, we direct the JMC as follows: -
i. Disclose quantity of sewage and sullage going in Primary, Secondary and Tertiary drains with the characteristics of effluents;1
ii. Take effective steps to ensure that untreated sewage is not discharge in the storm water drains and a proper drainage network is set up for discharge of sewage;
iii. Ensure that at least Primary drains are free from encroachment on both sides and adequate plantation with herbs and shrubs is done;
iv. Hon'ble Supreme Court of India by order dated 05.03.2019 passed in Civil Appeal No. 5016 of 2016 in the matter of Mantri Techzone Pvt. Ltd had directed to maintain following distance from Rajkulewas, waterbodies and wetlands:-
(i) in case of Lakes, 75 m from the periphery of water body.
(ii) 50 m from the edge of the primary Rajkulewas,
(iii) 35 m from the edge of Secondary Rajkulewas and
(iv) 25 m from the edge of tertiary Rajkulewas.
This buffer/green zone would be treated as no construction zone for all intent and purposes. Rajkulewas means a large storm water drain. Hence, aforesaid order of the Hon'ble Supreme Court needs to be complied with;
v. Daily monitoring of vulnerable locations/hot spots from where garbage is usually discharged into the storm water drains and its cleaning and taking penal action against defaulters in accordance with law is required;
vi. Hence, JMC and concerned RO of State Pollution Control Board (SPCB) will do the needful in this regard and concerned staff and officers of the Municipal Corporation should be vigilant to ensure that garbage is not discharged in the storm water drains;
vii. Performance of the STPs would be checked by concerned RO of MP PCB and report referring to the standard directed in OA 1069/18 by the Tribunal will be submitted before the next date of hearing;
viii. JMC will disclose the details of utilisation of 75.14 MLD of treated sewage and will also disclose the location where sewage and sullage flowing in the drains are discharged."
3. The JMC has filed the action taken report disclosing the status as under:

23. Out of the total 174 MLD sewage generated, approximately 76.50 MLD is presently being treated through 12 existing Sewage Treatment Plants (STPs).
4. Further it is also submitted that in areas, which is not connected to the sewerage network, on-site sanitation systems such as septic tanks are being used for treatment and safe containment of domestic wastewater.
5. This overflow from septic tanks, approx 97.50 MLD is being discharged into nearby minor drains, which ultimately joins 06 major drains of the city.
6. The details of sewage flow, diversion to STPs, and untreated discharge are as follows:

7. Effluent Characteristics of all Major drains are attached as ANNEXURE-1.

iv) Project Timeline is 03 years.
4. A separate DPR amounting to Rs. 397.60 Crore has been prepared for Zone 06, comprising 55 villages. The project includes:
i. 100% sewer network & STPs coverage in Zone 06 ii. Provision of 30,129 household sewer connections; The DPR has been prepared and submitted to the State Government for approval.
iv. This Project is likely to be taken under "Urban Challenge Fund".3
5. Pursuant to the aforesaid, there will be 100% sewerage facility for Jabalpur city.

16. It is humbly submitted that in Jabalpur, the major 8 JMC will disclose the Sewage Treatment Plants (STPs), i.e. 32 MLD, 34 MLD details of utilization of & 29 MLD, are based on SBR (Sequential Batch 75.14 MLD of treated Reactor) technology. 17. The Jabalpur Municipal Corporation (JMC) is actively reusing this treated water through various non- potable applications of approx 05%-10% of total treated water.
18. At present, approximately 20 separate water tankers are deployed for utilization of treated water in the following activities:
i. Irrigation and maintenance of around 91 developed parks having total of 3.50 lakhs SQM area.; ii. Watering of approximately 54000 sq. m. divider plantations;
iii. Road washing and cleaning activities;
19. Supply of water to nearby farmers for agricultural purposes.
20. Remaining treated water is being discharged in nearby Drains.
Planning to maximize the Reuse of Treated water;
21. Further, with the objective of maximizing reuse and promoting sustainable water management, JMC has proposed installation of tertiary treatment systems in all major STPs so as to produce higher quality treated water suitable for wider reuse applications in accordance with applicable CPCB guidelines.
22. It is humbly submitted that the remaining smaller STPs in Jabalpur are already provided with tertiary level treatment, and the treated water from such plants is being reused for construction purposes by contractors as well.
23. It is humbly submitted that the Jabalpur Municipal Corporation (JMC) is also undertaking further initiatives for maximizing the reuse of treated wastewater in the city. In this regard, JMC is preparing a Detailed Project Report (DPR) for optimum utilization of treated water by assessing demand and creating a structured reuse distribution system. The proposed DPR shall focus on supplying treated water to various bulk and institutional users, including:
i. Industries for non-potable industrial applications ii. Railways for washing, cleaning, horticulture, and allied uses iii. NHAI Road Authorities for irrigation of road divider plantations, avenue plantations, and maintenance activities iv. Irrigation department for providing treated water for irrigation purposes through their canal v. Public gardens, landscaping, construction works, and other permissible non-potable purposes.
The objective of the proposed DPR is to ensure maximum reuse of treated wastewater, reduce dependency on freshwater sources, promote circular water economy, and strengthen sustainable urban water management in accordance with applicable environmental norms and CPCB guidelines. Thus, JMC is proactively planning long-term infrastructure and policy measures for efficient reuse of treated sewage water across multiple sectors.6

24. Shah & Khandari drain merges in Lalpur, where it is diverted & being treated in nearby 34 MLD STP.
25. It is humbly submitted that the sewage flowing through Moti Drain, Urdana Drain, and Karonda Drain ultimately converges into Omti Drain. Thereafter, Omti Drain, having 97.50MLD sewage discharges, into the Pariyat River, which further joins the Hiran River. Subsequently, after flowing for approximately 130 km, the Hiran River merges into River Narmada at Sankal Ghat.
4. In respect of point 1, it is noticed that out of 174 MLD of sewage generated in the city of Jabalpur only 76.50 MLD is being treated meaning thereby the remaining untreated sewage is either finding its way to some natural water course or water body. The point 5 in respect of observation 01 discloses that 97.50 MLD is being discharged into nearby minor drains which ultimately join 06 major drains of the city, undisputedly these 06 major drains are storm water drains. In terms of the orders of the Tribunal untreated sewage cannot be permitted to be discharged in the storm water drains, therefore, expeditious steps are required to be taken to prevent the discharge of untreated sewage in the storm water drain.
5. Along with the report, the JMC has placed on record the notification dated 16.10.2025 issued by the State of Madhya Pradesh. The said notification requires plantation up to three meters on both side of the storm water drain. The relevant part of the notification in this regard is as under:

4.6.1 नगर य वरासत वाले े हे तु नयमन स म ा धकार वारा शी ता से वरासत मह व के मृ त च ह के संर ण एवं सध ु ार हे तु व तत ृ अ ययन कर ताव तैयार कए जाने चा हए। जब तक इस कार का अ ययन एवं ताव या वयन हे तु तैयार होते ह, तब तक स म ा धकार वारा चय नत एवं सच ू ीब ध वरासत भवन न नानस ु ार नयमन वारा तबं धत ह गे ।
- येक वरासत भवन का तबं धत े उसके समीपवत 100 मीटर े म या त होगा ।

6. In terms of the above, even the diversion of the land and development in that area is not permitted. Hence, the JMC is required to disclose the compliance of the above part of the notification in the next report.
7. The Municipal Commissioner, JMC appearing virtually has submitted that the plantation drive will be taken up during the forthcoming monsoon and in that process the above part of the notification will be duly complied with.
8. The said notification also mentions as many as 11 water bodies of the city wherein certain restrictions have been imposed for the protection of these water bodies. These are declared to be the sensitive areas. The relevant part of the notification in this regard is as under:

9. The JMC is required to disclose the area of these water bodies as per the original revenue record and the area which has been encroached upon and the attempts which have been made by the JMC to preserve and rejuvenate these water bodies.10
10. The PCB is required to take water samples from these water bodies, analyse them and disclose the water quality of these water bodies by filing a separate report before the next date of hearing.
11. The MPPCB has filed the report dated 15.05.2026 disclosing the progress which has been made between August 2024 and September 2025 as under:

12. The water quality analysis has also been placed on record by the PCB in respect of certain points but that is not enough. Hence, the PCB will file a separate report disclosing the water quality of the storm water 11 drains and the water quality of river Narmada where these storm water drains/STPs are discharging the sewage/treated water.
