Appellant-wife has filed the present appeal against the judgment and decree dated 20.03.2018 passed by learned Additional District Judge, Sangrur whereby the petition under Section 13 of the Hindu Marriage Act, 1955, (for short 'the Act'), filed by the respondent- husband for dissolution of marriage by a decree of divorce was allowed.

In the present case, the marriage between the parties was solemnized on 27.07.2003 at Dhuri according to Sikh rites and ceremonies. One girl child namely Ankdeep Kaur was born out of the wedlock in the year 2005. The marriage did not work and the parties started living separately. A petition under Section 13 of the Act for grant of decree of divorce on the grounds of cruelty and adultery was filed by the respondent-husband which was allowed by learned Additional District Judge, Sangrur, vide judgment and decree dated 20.03.2018. Against the said judgment and decree, the appellant-wife has preferred the instant appeal.

Notice of motion in the instant appeal was issued on 26.04.2018 and thereafter on 04.05.2022 the parties were directed to remain present in the Court so that possibility of an out of Court settlement between them can be explored.

On 25.05.2022, the parties were present in the Court and they had amicably settled the matter with the assistance of their respective counsel. The respondent-husband was agreed to pay Rs.50,00,000/- in lieu of permanent alimony which was accepted by the appellant-wife. First motion statements of the parties were recorded on 25.05.2022.

The parties are also present in the Court today. A demand draft No.004156 dated 27.05.2022 amounting to Rs.20,00,000/- in favour of the appellant-wife and a demand draft No.004157 dated 27.07.2022 amounting to Rs.30,00,000/- in favour of the daughter have been handed over to the appellant-wife by the respondent-husband in the Court. Second motion statements of the parties have been recorded. It is stated by both the parties that they will withdraw all the pending cases/complaints, if any, filed by them against each other and will not file any case/complaint concerning this matrimonial relationship, in future.

Learned counsel for the appellant submits that daughter- Ankdeep Kaur has carried a little fear that her father may not stop talking to her.

The respondent-father, who is present in the Court, submits that he will always remain in touch with his daughter. For this purpose, the appellant and her family members will also remain positive towards the emotional needs of the girl.

Keeping in view the amicable settlement between the parties, no further directions are required to be given in the present appeal which is disposed of accordingly.
