             THE HONOURABLE SRI JUSTICE M.LAXMAN

               CRIMINAL PETITION No.5268 OF 2023

ORDER:

1. This petition is filed seeking anticipatory bail under Section 438 of Criminal Procedure Code, 1973 (Cr.P.C) by the petitioner for unregistered crime on the file of Dharmaram Police Station, Peddapalli District. The offences alleged against the petitioner are under Sections 376 and 420 of the Indian Penal Code, 1860.

2. The sum and substance of case of the petitioner is that the petitioner and respondent No.3 herein fell in love with each other and they got engaged. Respondent No.3 allegedly got a better person to marry than the petitioner and she wanted to get rid of the petitioner. She also allegedly had intercourse with the petitioner, but in order to get rid of him she is trying to lodge a false complaint with police. Therefore, the petitioner apprehends that police may arrest him basing on the complaint that she may lodge. Hence, the present petition is filed seeking anticipatory bail.

3. Heard both sides.

4. Learned Additional Public Prosecutor reported that no complaint has been received by the concerned police. 2

The petitioner filed the present petition without placing any material on record which would establish that some reasonable ground exists for his apprehension and such apprehension is well founded. The apprehension entertained is self assumption. Hence, it is not a fit case to grant anticipatory bail as prayed for.

6. In the result, the Criminal Petition is dismissed. No order as to costs. Miscellaneous petitions, if any, pending shall stand closed.
