There are three set of appeal which are being
disposed of by this common judgment.

2. The land owners have challenged the acquisition
of their lands in Mauja Pahari and Ranipur for construction of
Patna Metro Rail Yard on account of non-compliance of
provisions of Right to Fair Compensation and Transparency in
Land Acquisition, Rehabilitation and Resettlement Act, 2013
(hereinafter called "the Act of 2013") which was rejected by
the learned Single Judge. However, with respect to quantum
of compensation to be paid to the land owners, it has been
directed that the un-revised MVR/Circle Rates be revisited
first taking into consideration all relevant factors including the
opinion of the experts, whereupon only the compensation
amount to the land owners be refixed and paid on the basis of
revised MVR/Circle Rates.
3. On the issue of rehabilitation and resettlement,
the State Government and the Collector, Patna have been
directed to consider the recommendation of the Expert
Committee.
4. This part of the judgment has been challenged by
the State of Bihar and Patna Metro Rail Corporation
(hereinafter referred to as "PMRC")

5. The introductory facts are as follows:-
After the approval of Patna Metro Rail Project
(PMRP) on 09.10.2018 by the Cabinet of the State of Bihar,
land was required to be acquired.
6. M/s Rail India Technical and Economic Services
(RITES) gave the proposal for two depots to be constructed.
7. It would be worthwhile to mention that in the
year 2019, the work of construction of metro rail and depot in
Patna was given by Patna Metro Rail Corporation Limited
(PMRCL) to Delhi Metro Rail Corporation (DMRC) which was
approved by the State of Bihar. The DMRC, thereafter, made
changes in the line alignment of Patna metro on 08.02.2020.
The location of metro depot from two suggested locations was
also changed to one location at Mauza-Pahari and Ranipur, for
which land was sought to be and was acquired under the 2013
Act.
8. The Urban Development and Housing
Department, Govt. of Bihar vide office order dated
17.03.2020outlined the reasons for relocation of the metro depot citing that depot at earlier location would have resulted Patna High Court L.P.A No.45 of 2024 dt.27-02-2025 44/71 in demolition of many houses, disturbing the drainage system and the present location would have seamless integration with ISBT and metro depot. It was also notified that 11.06 hectares of land would be required for the purposes of property development area.
9. The revised detailed project report was approved by the State and the Central Government.
10. The objection hearing on the Social Impact Assessment Report was held on 04.06.2021 and the report of the Social Impact Assessment was prepared and published on 14.06.2021. Thereafter, an expert committee was constituted on 23.06.2021 which submitted its report on 30.06.2021. Thereafter the notification under Section 11 of 2013 Act was issued on 23.10.2021.
11. Objections were filed by the land owners on 23.12.2011 which were rejected. Finally, the declaration notification under Section 19 of the 2013 Act was published on 11.05.2022. The award under Sections 23 and 30 of the 2013 Act was published on 04.08.2022.
12. Many of the land owners / writ petitioners / Patna High Court L.P.A No.45 of 2024 dt.27-02-2025 45/71 appellants approached this Court for quashing of the land acquisition notice issued under Section 11 of the 2013 Act with respect to 75.96 acres of land; for setting aside the Social Impact Assessment Report prepared by the Development Management Institute, Patna; quashing of the formation of technical expert committee constituted under Section 7 of 2013 Act as also its report dated 30.06.2021; for quashing the order dated 02.02.2022 passed by the District Land Acquisition Officer (DLAO), Patna for quashing paper publication under Section 19 of 2013 Act as also the award dated 04.08.2023 prepared in Land Acquisition Case No. 29 / 2021-22 under Sections 23 and 30 of 2013 Act.
13. On behalf of the writ petitioners/land owners it was argued before the learned Single Judge that the decision to change the location of the depot was hasty and based on no good reason. In the afore-noted selected sites for the depots, there were no historical structures or archaeological complex or residential houses which had to be demolished. The contention of the State that the line alignment was changed to protect the archaeological complex Patna High Court L.P.A No.45 of 2024 dt.27-02-2025 46/71 at Kumhrar was incorrect as the two earlier cited locations at Mauza Etwarpur and Ramchak Bairia were far away from Kumhrar. In fact, if the earlier locations would have been used for construction of depot, lesser number houses would have had to be demolished. It was also contended that the technical reason for changing the line alignment was definitely subject to judicial review in the event of there being apparent error on facts and assessment.
14. It has also been urged that such hasty decisions have not been approved of by the Supreme Court in Inderpreet Singh Kahlon and Others vs. State of Punjab and Others; (2016) 11 SCC 356 and Bahadursinh Lakhubhai Gohil vs. Jadishbhai M. Kamalia and Others; (2004) 2 SCC 65.
15. Their other contention before the writ court was that there was complete non-compliance of Section 4 of the 2013 Act with respect to Social Impact Assessment. The process adopted was perfunctory. The alternative land suggested by the land owners, namely, the Dumping Yard and the Sahara Land was not considered while preparing the Patna High Court L.P.A No.45 of 2024 dt.27-02-2025 47/71 Social Impact Assessment Report. There was also no finding in the report regarding alternative land as also the assessment of the bare minimum land required as mandated under Section 4(4) (d) of 2013 Act. It was also urged before the writ court that the Social Impact Assessment was conducted by Development Management Institute, Patna, sometimes in the month of June, 2021 when the entire country including the State of Bihar was reeling under Covid
-19 pandemic.
16. In sum and substance, the arguments raised before the writ court on behalf of the land owners was that there was complete non-compliance of Section 4 of 2013 Act read with the rule 6 and 10 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement (Social Impact Assessment and Consent) Rules, 2014 (hereinafter called "the Rules of 2014"). The acquisition process was also hit with the vice of non-compliance with Sections 5, 6, 7, 8, 11, 15, 16 and 19 of the Act of 2013.
17. The challenge was met with the Patna High Court L.P.A No.45 of 2024 dt.27-02-2025 48/71 countervailing arguments on behalf of the State that PMRP is an ambitious project which would prove a game changer in future. All over the world, metro rail is recognized as an efficient, economical and faster mode of public transport. The importance of laying metro line also lies in the exponential growth of population of Patna and the burgeoning business activities in and around the city. The project would also go a long way in minimizing air pollution.
18. Patna Metro Rail Project (PMRP) is a joint venture of State of Bihar and Govt. of India. RITES, a Govt. of India undertaking was entrusted with the task of assessing the feasibility of the project report by Urban Development and Housing Department, Govt. of Bihar. The project report of the first phase of PMRP was to have two corridors, namely, East - West and North- South corridors. The PMRCL was incorporated as special purpose vehicle for the said project. The construction work of the two corridors of PMRP along with the depot and property development area were allotted to DMRC on 04.09.2019 which had the approval and sanction of the Cabinet. The DMRC suggested changes in the line of Patna High Court L.P.A No.45 of 2024 dt.27-02-2025 49/71 alignment in order to save the historical and archaeological sites of Kumhrar and in the process suggested that instead of two depots, only one depot would suffice which could be constructed at the eastern side of the State Highway No. 1, falling in Mauza Pahari and Ranipur. The detail project report was then sent to the RITES with the aforesaid suggestion. Based on that, a fresh project report was prepared which was considered and approved by Japan International Credit Agency as well as Govt. of India.
19. Because of this revised project, the total cost, as contended by the State, of PMRP was reduced to several crores.
20. Thereafter a requisition for total of 76.7450 acres of land was made by PMRCL. Since some of the lands at the selected site for depot at Ranipur was Gair Majarua Aam Land, only 75.95 acres of land was required for construction of depot and property development area. The rest of the land acquired, which was Gair Majarua Aam Land, was transferred to PMRCL. Only thereafter, the acquisition proceedings were initiated.

21. It was the contention of the State that the Social Impact study was conducted by Development Management Institute, Patna in which 250 people as well as representatives of Ward No. 56 had participated. The report of the Institute recorded that the positive impact would be higher than the negative impact. The report was examined by an independent expert committee duly constituted in term of Section 7 of 2013 Act., which also recommended the proposed acquisition for timely completion of the project.
22. Altogether 759 objections were submitted, which were disposed off. Only thereafter, a notification under Section 19 of 2013 Act was published on 11.05.2022 and award was prepared in L.A. Case No. 29/2021-22 for 50.595 acres of land at Mauza Pahari on 04.08.2022 and L.A. Case No. 30/2021-22 for 25.35 acres of land at Mauza Ranipur on 05.09.2022. The physical possession of the entire 75.95 acres of land was handed over to PMRCL. The structures and constructions over the acquired land was measured by a six member committee which reported that altogether 37 houses and 101 boundary-walls were required to be demolished. 23. It was reminded that viability of a metro rail is not solely dependent on the fare recovered from commuters but also on non-fare box revenue. The property development by the metro rail is one of the accepted modes of resource mobilization towards capital cost as also for providing sustainable operation. So far as the conservation of the interest of land owners is concerned, the State considered the entire land to be residential for the purposes of payment of compensation even though there were only 37 houses and few boundary-walls over the entire acquired land. The majority of the acquired land is agricultural and vegetables had hitherto been grown there. The six men committee, referred to above, in its report dated 22.06.2021 had considered the nature of the entire land under acquisition as agricultural.
24. Section 26 of the 2013 Act lays down the criteria for determining the market value of land. They are:
(a) market value for the registration of sale deed and agreements to sell in the area where the land is situated; or
(b) the average sale price of similar type of land situated in Patna High Court L.P.A No.45 of 2024 dt.27-02-2025 52/71 the nearest village or nearest vicinity area; or (c) consented amount of compensation as agreed upon under sub-section (2) of Section 2 in case of acquisition of lands for private companies or for public private partnership projects, whichever is higher. The date for determination of market value would be the date on which the notification was issued under Section 11 of 2013 Act.
25. It was contended by the State that for the residential branch road, the higher average rate of 50% of the sale deeds were found to be Rs 5,53,97,288/- per acre whereas the MVR for Mauza Pahari had been found to be Rs. 5,50,00,000/- per acre. Therefore, the higher rate of Rs. 5,53,97,288/- per acre was considered for payment of the compensation amount as per provisions under Section 26 of 2013 Act. Similarly, for residential main road, the rate of Rs. 7,59,37,500/- per acre was decided. Similar rate fixation has been done for lands at Mauza Ranipur and which ever was higher of the two has been considered.
26. The last of the arguments on behalf of the State was that since the takeover of the land by PMRCL, Patna High Court L.P.A No.45 of 2024 dt.27-02-2025 53/71 substantial progress has been made in the construction of the metro rail and at the time when the writ petitions were being argued, 44% of construction work had already been achieved whereas 42.5% of the financial investments had been made. It was thus argued that any interference at that stage, would derail and frustrate the project which would enure in no one's favour. It was also pointed out that the objectors are owners of only 5 acres of land out of the total acquired land and because of their intransigence, the prospect of entire project would be jeopardized.
27. It was vehemently argued by the State before the writ court relying upon Nand Kishore Gupta and Others v. State of Uttar Pradesh and Others, (2010) 10 SCC 282; G. Narsing Rao (Died) through LRS v. The National Highway Authority of India and Another (SLP (C) Nos. 9314-9315/2022), Ramji Veerji Patel and Others v. Revenue Divisional Officer and Others, (2011) 10 SCC 643; Ramniklal N. Bhutta and Another v. the State of Maharashtra and Others, (1997) 1 SCC 134; Godrej and Boyce Manufacturing Co. Ltd. v. State Patna High Court L.P.A No.45 of 2024 dt.27-02-2025 54/71 of Maharashtra through the Government Pleader and Others (Writ Petition No. 3337 of 2019), State of Haryana v. Eros City Developers Private Limited and Others, (2016) 12 SCC 265; and Dr. Abraham Patani of Mumbai and Another v. State of Maharashtra and Others, (2022) SCC ONLINE SC 1143 that even if there are some minor procedural irregularities, acquisition of land for infrastructural project in public interest should not be stalled and the exercise of discretionary jurisdiction under Article 226 of Constitution of India should only be cautiously exercised. The alternative land suggested by the land owners was taken into consideration but was not found to be viable as it would have made the project dearer by 500 to 700 crores. The selection of land, unless shown to be arbitrary, unreasonable and malafide lies in the domain of acquiring authority (refer to Ramji Veerji Patel vs. Revenue Divisional Officer; (2011) 10 SCC 643 and G. Narsingh Rao vs. National Highways Authority of India Ltd; (SLA (C) No. 9314-9315/2022.
28. Similar arguments were raised by the Patna High Court L.P.A No.45 of 2024 dt.27-02-2025 55/71 PMRCL.
29. The learned Single Judge framed the following issues to decide the competing claims of the parties, namely, (i) whether the provisions of 2013 Act have been followed for acquiring the land in question; (ii) the issue of rehabilitation and resettlement and; (iii) whether the property development area and the depot area are integral part of PMRP and lastly (iv) whether the PMRP including the property development area is a project in larger public interest.
30. The learned Single Judge on the issue of breach of Rule -11 (3) of Rules of 2014 mandating that public hearing must be announced three weeks in advance through daily newspaper and clear 21 days time is required to be given to the landholders, held that from the materials put forth by the parties, it transpired that in the public hearing during the course of preparation of Social Impact Assessment Report by the Development Management Institute, Patna, 111 persons had participated but according to the State, 250 people as well as representatives of Ward No. 56 had participated and that there was substantial compliance of the Patna High Court L.P.A No.45 of 2024 dt.27-02-2025 56/71 provisions except some procedural lapses here and there.
31. In the opinion of the learned Single Judge, the Social Assessment Impact Report clearly stated that the positive impact had a higher quotient than negative impact. With respect to the opposition regarding non-consideration of alternative sites suggested by the land owners, the learned Single Judge was of the view that the same was considered but not found to be suitable as the site suggested for construction of depot would have incurred extra cost ranging between 500-700 crores and that no interference was required since the construction work has started at the selected site and the progress was to the extent of 44%. Majority of the land owners, it was found, had already received compensation to the tune of Rs. 130 crores. The suitability of land, the learned Single Judge agreed, fell in the domain of the acquiring agency as also the agency executing the project and they are the best judge to decide the suitability and feasibility of the project including the site selected. Relying on Ramji Veerji Patel (supra), it was held that it was not open to the Court to examine the aspect Patna High Court L.P.A No.45 of 2024 dt.27-02-2025 57/71 of suitability and the Court substituting its opinion with that of the acquiring and executing agency.
32. With respect to the objection regarding the formation of the Expert Committee for appraisal of Social Assessment Impact Report as mandated under Section 7(2)
(b) of 2013 Act, the revelation by the Advocate General that the proposal of the Expert Committee was not considered by the State Government as it was not found to be viable, was taken into account.
33. The argument with respect to the property development area component of the project not being relatable to public purpose, it was held that in view of the reason that Metro Rail Policy, 2017 contemplated provisions for enhancement of revenue of the Metro rail projects and included commercial/property development at stations and on other urban land which could be used as key instruments for maximizing revenue in Metro rail/railway systems in the cities, no fault could be found. The exemplars were drawn from Hongkong and Tokyo. It was found from the records that while conceiving of the project, the State had taken into all Patna High Court L.P.A No.45 of 2024 dt.27-02-2025 58/71 the above factors which would increase the non-fair box revenue which was in sync with the Metro Rail Policy, 2017 and hence the construction and development of property development area was held to be part of the public purpose and it was complementary to each other and therefore integral to the scheme of PMRP.
34. It was thus concluded, in view of the judgment in Godrej & Boyce vs The State Of Maharashtra (supra), that even if there are some irregularities in the procedure followed by the acquiring authority for infrastructural project, the Courts, in exercise of their extraordinary discretionary power under Article 226 of the Constitution of India ought not to interfere, especially when the project is of public importance. In matters of land acquisition for public purposes, the interest of justice and public interest intermingle.
35. The learned Single Judge, therefore, refused to interfere with the process of acquisition.
36. However, while considering the issue of just and fair compensation to which the land owners would be Patna High Court L.P.A No.45 of 2024 dt.27-02-2025 59/71 entitled, a direction was issued that the MVR/Circle Rates which had not been revised since long by the Collector, be revised after taking into consideration the relevant factors including the opinion of the experts and then re-fix the compensation amount payable to the land owners based upon the revised MVR/Circle Rate.
37. While assailing the judgment of the learned Single Judge, Mr. Amit Sibbal, the learned Senior Advocate appearing virtually argued that even though right to property has ceased to be a fundamental right after the 44 th amendment of the Constitution, it continues to be a constitutional right under Article 300A and therefore any expropriatory law which deprives a person of his property must be in line with the overarching principles of law and must be just fair and reasonable. The exercise of power of eminent domain ought to be construed narrowly in favour of a person's right to his property. It was argued that the land owners would not do good by challenging the public purpose behind the acquisition proceedings. The challenge thus is primarily to the manner in which the proceedings were Patna High Court L.P.A No.45 of 2024 dt.27-02-2025 60/71 concluded with complete disregard to the statutory safeguards. Whether the land is to be acquired under the Act, under the new law cannot be a unilateral decision. The process has to be humane, informed and transparent with least disturbance to the owners of the land and the affected families and the deprived persons would be entitled to just and fair compensation.
38. In this context, it was argued that Social Impact Assessment study is not a mere formality and the learned Single Judge has erred in law in being satisfied about substantial compliance of the provision, looking aside procedural lapses here and there.

(2024) SCC Online SC 937; Patna High Court L.P.A No.45 of 2024 dt.27-02-2025 61/71 Kamal Trading Pvt. Ltd. vs. State of West Bengal (2012) 2 SCC 25; Rajesh K vs. Managing Director, Kerala Rail Development Corporation (WP(C) 41009/22 (Kerala High Court) and Manekbben Rama Tandel vs. The Collector, Daman, Union Territory of Dadra and Nagar Haveli & Daman and Diu & Ors.
(MANU/MH/1796/2023), it was argued that the importance of property rights and requirements of strict adherence to procedure cannot be ignored or by-passed or else the entire acquisition proceeding gets vitiated.
40. Taking the argument of "acquisition by ambush" further, which is impermissible, it was pointed out that there was complete disregard to the procedural safeguards under Sections 4, 5, 7, 8, 11, 15, 16 and 19 in as much as there was no finding or analysis with regard to land being the bare minimum land required for public purpose. Even with respect to rejection of the alternative places where the depots could be constructed, it was argued that it was not prudent to discard such suggestions as the land suggested viz. The Sahara land, Gair Mazarua lands and a dumping yard in Patna High Court L.P.A No.45 of 2024 dt.27-02-2025 62/71 close vicinity to the selected site would have caused minimum displacement and minimum requirement to resettle and rehabilitate human heads. It would have reduced the cost of acquisition for the Government. The rejection was not based on any sound reason.
41. A special grievance was made with respect to only three days having been given for voicing the objection in place of clear 21 days and that also at a time when the State was swept by COVID -19 pandemic. A special reference was made to the letter of one Councilor viz. Smt. Kismat Devi of Ward No. 56, where she had highlighted the difficulties faced by the affected people of the area and inefficacy and the infirmities in the S.I.A. study being conducted by the State. Even if the argument on behalf of the State that 250 people had participated in the public hearing, the persons affected were numbering around 1300.
42. Section 15 of the 2013 Act provides the right of the people affected by the land being acquired under Section 11 notification to raise objections with respect to the suitability of the land being acquired and the findings of the Patna High Court L.P.A No.45 of 2024 dt.27-02-2025 63/71 S.I.A. study report. The objections raised by the displaced persons are stated to have been mechanically rejected without due consideration. The learned Single Judge having lightly dealt with the lapses suggested that it was not understood that the preparation of Social Impact Assessment Report and its vetting by the Special Expert Committee are the heart and soul of the Act and represent the very purpose of the humane, participative, informed and transparent process of land acquisition envisaged under the scheme of the Act. The argument of the State as also PMRCL regarding non- suitability of the alternative site was not based on any pleadings on affidavit or any minutes of the meeting of a technical body or any data or reasoning. The dumping yard displacing none, in fact, could have been shifted elsewhere and that land which in itself would have sufficed the purpose could have been selected as the site in fact in one of the writ proceedings sometimes in the year 2012, the High Court had directed the State to consider relocating the dumping yard as it was within the municipal limits and was causing pollution and other health hazards.

43. Mr. Sibbal further grieved that the Advocate General had only supplied a ballpark figure of 45% of the construction work done without affording any evidence for the same. The claim was seriously disputed and it was argued that only about 5% of the work had been completed and that too only at the fringes of the site. The land owners denied that the majority of the land owners in the affected area had received compensation to the tune of Rs. 130 Crores which accounts for almost 90% of the total compensation.
44. It would be worthwhile to mention that the argument on behalf of the State was that none of the land owners who had approached the Court were the original inhabitants of the area, rather they had purchased the land through sale deed. The contention was rightly opposed by the land owners that there is no place for any illusionary distinction between land owners and original inhabitants especially when Section 3(R) of the 2013 Act defines the land owner as any person whose name is recorded as the owner of the land or building in the records of the authority concerned. In all the cases referred to by the State and relied by the Patna High Court L.P.A No.45 of 2024 dt.27-02-2025 65/71 learned Single Judge the issues were different. In Godrej & Boyce (Supra), the alternative land was proposed by the appellant and accepted by the State. In that case, the challenge was to the vires of Section 25 of the Act. However, there was no displacement as land was barren and unused and the acquisition was under Section 10(A) which is exempt from the application of Chapter II and III of the Act of 2013. Likewise, in G. Narsingh Rao (Supra), the acquisition was done by the National Highway Authority of India which is specifically excluded from the Act under Section 105 read with Schedule IV.
45. In Ramji Veerji Patel (supra), the alternative land suggested during the acquisition proceedings were duly considered and found to be not feasible. In the present instance, it was argued the suggestions of the alternative land were never considered seriously. As to the claim of the State that compensation has been calculated after following the procedure as laid down under Sections 26 and 27 of the Act and the determination of market value of land has been compared with the MVR and average sale deed Patna High Court L.P.A No.45 of 2024 dt.27-02-2025 66/71 of previous three years and using the one which was higher, the compensation amount was fixed and that apart from the market value 100% solatium, applicable interest and value of structures also have been accounted for, Mr. Sibbal argued that the MVR/Circle Rate of the subject land was last revised in 2014, whereas the prices of land have significantly increased in the past and that the first proviso to Section 26 of the Act clearly states that the determination of market value shall be the date on which the notification under Section 11 had been issued. If an average of last three years' sale deeds is taken into account, it is only slightly higher than MVR rate fixed in 2014. Therefore a fair compensation and proper compliance of Section 26 would be when the comparison is made with the updated MVR, which would have been much higher.
46. After having heard the parties, we are also of the view that with respect to objections being heard only on a three days' notice was not proper. The Government/acquiring authority ought to be more careful in future.

47. However, there is no gainsaying that establishment of Metro line in the city of Patna is in public interest. No further ink is required to be wasted in deciding whether it is in public interest or not. Relieving the city- dwellers of traffic congestion, providing fast moving traffic and the income generated from the property development area are by no means opposed to public interest.
48. In Kolkata Municipal Corporation & Anr. v. Bimal Kumar Sah & Ors. (2024) 10 SCC 533 , the Supreme Court while examining the validity of the acquisition of property by Kolkata Municipal Corporation in exercise of its powers under Section 352 of the Kolkata Municipal Corporation Act, 1980, tested the acquisition on the anvil of the seven principles enunciated regarding the right to property viz. (i) the right to notice; (ii) the right to be heard;
(iii) the right to a reasoned decision; (iv) the duty to acquire only for public purpose; (v) the right of restitution or fair compensation; (vi) the right to an efficient and expeditious process and; (vii) the right of conclusion.
49. A prior notice informing that the State Patna High Court L.P.A No.45 of 2024 dt.27-02-2025 68/71 intends to acquire is necessary which notice ought to be clear, cogent and meaningful. Equally important would then be the right of the property bearer to communicate his objections and concerns to the authority acquiring property which process must be meaningful and not a mere sham.
50. It is incumbent upon the authority to take an informed decision and communicate the same to the objector. One of the inherent and an important fetter on the discretion of the authorities to acquire is that acquisition must be for a public purpose. It must stand to reason with the larger constitutional goals of a welfare State and distributive justice. Any deprivation of property right is permissible only upon restitution. Since the process of acquisition may be traumatic for many, there should not be any administrative delays and the process must be efficient and expeditious. The process must be taken to its conclusion which is acquisition of the property and payment of compensation.
51. All these principles inhere in the Act of 2013.
52. The land owners were noticed; their Patna High Court L.P.A No.45 of 2024 dt.27-02-2025 69/71 objections were heard; they were informed about the rejection of their objections and; they were also heard with respect to suggestion regarding other sites. The compensation amount has been fixed and the process has been speeded up to perhaps the maximum possible limit. It must stand concluded with the net result that the Metro line should become functional without any delay. So far as quantum of compensation is concerned, we do reckon that revising the MVR/Circle Rates which are of the year 2014 is urgently needed.
53. However, the direction of the learned Single Judge that it should be done first and then compensation be paid, would not be practical in the sense that updating the Circle Rates require time and in the present circumstance, time would be the essence especially if seen in the context of the land owners who have been divested of their land who would require money urgently for their resettlement.
54. The procedure adopted by the State in comparing the MVR rates with the sale deeds exemplars in the Patna High Court L.P.A No.45 of 2024 dt.27-02-2025 70/71 last three years and the highest being given to the land owners appears to us to be absolutely justified.
55. While reiterating the importance of the various provisions of the Act of 2013, which need to be complied with to the fullest before acquiring lands. The Supreme Court in Delhi Metro Rail Corporation, 2023 Live Law SC 363, ruled that disturbing the process of acquisition and compensation would not be appropriate, looking at the positive impact viz., fast traffic, saving the cost of acquisition, practically no destruction of buildings etc., and the stage of construction to the extent of 30%. In that case, a concern was expressed over diversion of various areas of land in morphological ridge for non-forest purposes. In the context of PMRP, we find that disturbing the process of acquisition, more so when more than 45% of work has already advanced would not be correct. It would not only result in huge escalation of cost but loss to the public exchequer also.
56. We, therefore, find that the acquisition is for public purposes and the objections of the land owners are not valid. However, we have also found that the manner of Patna High Court L.P.A No.45 of 2024 dt.27-02-2025 71/71 computation of compensation to be paid to the land owners is justified.
57. We, therefore, modify the judgment of the learned Single Judge and direct that the MVR/Circle rates of 2014 must be updated, which would be an independent exercise which shall be carried out by the State after observing the due process in that regard but the payment of compensation to the land owners would not be contingent on such updation as it would take long time.
58. Thus the appeals on behalf of the land owners are dismissed whereas the appeals preferred by the State and the PMRC are allowed to the extent indicated above.
59. All the appeals and Interlocutory Applications are disposed off.
