This Court on 27.05.2010 directed the respondents to refix the emoluments by reducing the special increment only. As a consequent to refixation, the retrial benefits were directed to be released within a period of two months and interest at the rate of 6%, where statutory interest is not provided and statutory interest, where it is so provided.

Today Mr. S.S.Sahu has filed reply by way of affidavit of K.C.Bhagat, Executive Engineer-respondent No.2. The same is taken on record. In the reply, it has been pointed out that in pursuance of the directions of this Court, interest on the gratuity, leave encashment and on delayed payment of pension has been paid to the petitioner. However, in respect of arrear of pension, the Accountant General has issued instructions to the District Treasury Oficer to deposit such arrears. Mr. Sahu states that such arrear shall be paid to the petitioner within a period of two months.

In view of the above, the present contempt petition is disposed of as having been rendered infructuous. The respondents shall remain COCP No.581 of 2010 2 bound by the statement. In case, the arrears of pension are not paid to the petitioner, it shall be open to the petitioner to seek revival of the contempt petition.
