                                    ORDER

1. The appellant filed an online application under the Right to Information Act, 2005 (RTI Act) before the Central Public Information Officer (CPIO), Nuclear Power Corporation of India Ltd. (NPCL) seeking information pertaining to the number of Contributory Health Service Scheme (CHSS) holders taking facility from Rajasthan Atomic Power Station (RAPS) Hospital including, inter-alia, name of CHSS holder, CHSS number, date of birth, relation with employees etc. Page 1 of 3

The appellant filed a second appeal before the Commission on the grounds that the CPIO wrongly denied the list of beneficiaries taking exemption under Section 8(1)(j) of the RTI Act and that on appeal, the FAA upheld the decision of the CPIO. The appellant requested the Commission to direct the CPIO to provide the information sought by him and also to impose penalty on the erring officials.

Hearing:

3. The appellant Shri L K Arya and the respondent, Shri Taufiq Siddiqi, Manager(HR), Deemed PIO, Nuclear Power Corporation of India Ltd., Rawatbhatta, Rajasthan attended the hearing through video conferencing.

4. The appellant submitted that information sought for has been wrongly denied to him by claiming exemption under Sections 8(1)(j) of the RTI Act.

5. The respondent submitted that the information sought for relates to the personal information of third parties, the disclosure of which has no relationship to any public interest and would cause an unwarranted invasion of the privacy of the third parties. Hence, its disclosure is exempted under Section 8(1) (j) of the RTI Act and same was informed to the appellant vide letter dated 09.02.2018.

Decision:

The Commission, after hearing the submissions of the respondent and perusing the records, observes that the information sought for relates to the personal information of third parties, the disclosure of which has no relationship to any public interest and would cause an unwarranted invasion of the privacy of the third parties. Hence, its disclosure is exempted under Section 8(1)(j) of Page 2 of 3 the RTI Act. In view of this, no further intervention of the Commission is required in the matter.
7. With the above observations, the appeal is disposed of.
8. Copy of the decision be provided free of cost to the parties.
