Section 44(2) in The Maharashtra Village Panchayats Act, 1959
(2)[ Subject to the provision of sub-section (1A) of section 145, [the panchayat] [Section 44 was renumbered as sub-section (1) and sub sections (2) and (3) were inserted by Maharashtra 36 of 1965, Section 23.] shall have power to act notwithstanding any vacancy in the membership or any defect in the constitution thereof; and such proceedings of the panchayat shall be valid notwithstanding that it is discovered subsequently that some person who was not entitled to do so sat or voted or otherwise took part in the proceedings.
