1. Plaintiff being tenant in respect of premises bearing no. R 49, Greater KailashI, New Delhi (hereinafter referred to as "the suit property") has filed this interpleader suit, praying for a decree of declaration of the legal heir of late Lt. Gen. Ajit Singh (hereinafter referred to as "the now deceased landlord") entitled to receive rent of the suit property and also praying for a decree of indemnification. Originally this suit was filed on the Original Side of the Hon'ble Delhi High Court but on account of enhancement of pecuniary jurisdiction of the District Courts, this suit got transferred and my predecessor District Judge retained the suit in this court for disposal. Written statements were filed by the now deceased landlord's legal heirs who had been impleaded as defendants in the suit. In the course of proceedings of this suit, one of the legal heirs namely Shri Har Chand Singh (defendant no.
4) passed away and subsequently his legal representatives were brought on record. There were certain disputes between the defendants interse, to the extent relevant for the present interpleader suit, but during pendency of this suit, the defendants settled all their disputes.
2. The factual matrix as pleaded by plaintiff in the plaint is as follows. Plaintiff company took the suit property on lease by virtue of registered lease deed dated 07.03.2012 executed by the now deceased Suit No. 209562/2016 Diwakar Enterprises vs Alamdeep Singh & Ors. Page 4 of 9 Pages landlord. The said lease was for a period of three years. After execution of the said lease, the now deceased landlord Lt. Gen. Ajit Singh passed away. On coming to know about demise of the now deceased landlord, plaintiff contacted legal representatives of landlord for payment of rent vide letter dated 24.12.2014 followed by legal notice and reply. But no clarity was being offered by the legal representatives of the now deceased landlord and at the same time they were also refusing to accept rent. Plaintiff was informed about Will dated 05.01.2007 left behind by the now deceased landlord, but a copy of the same was not provided despite written request. It appeared to plaintiff that there was no consensus amongst the executors, so vide letter dated 12.12.2014, the present defendant no. 1 asked for deposit of future rent in his name. But thereafter vide letter dated 27.01.2015, plaintiff was asked to pay the rent jointly in the name of all three executors. Since the now deceased landlord had left behind several legal representatives, plaintiff requested the defendants to disclose names of all the legal representatives or provide the necessary documents related to succession of the estate of the now deceased landlord. Finally, as there was no clarity as to who had succeeded the rights pertaining to tenancy in respect of the suit property, plaintiff issued legal notice dated 11.03.2015 to the defendants. Upon service of the said legal notice, the defendants invited the plaintiff for a meeting on 26.03.2015 but parties could not arrive at any conclusion on account of interse disputes between the legal representatives of the now deceased landlord. It is under these circumstances, that plaintiff brought the present interpleader suit.

In his written statement, the now deceased defendant no. 4 admitted the plaintiff to be tenant in respect of the suit property and also disclosed the family tree as well as particulars of class I legal representatives of the now deceased landlord. Defendant no. 4 also pleaded about inheritance disputes and litigation pending interse the defendants. However, in his written statement, defendant no. 4 prayed that plaintiff be directed to pay 1/4th share of the rent in his name.

Defendant no. 9 also filed written statement similar to the that of defendant no. 4, disclosing the particulars of class I legal representatives of the deceased landlord as well as family tree and inheritance litigation and prayed that plaintiff be directed to pay 1/8th of rent to defendant no. 9 towards his share.

Defendants no. 8,10, 11 and 12 filed joint written statement in which they admitted the initial tenancy status of plaintiff but further pleaded that since plaintiff violated the terms of lease, it has ceased to be a lawful tenant and is now in illegal possession of the suit property. It was further pleaded by the said defendants that plaintiff is liable to immediately vacate the suit property. The said defendants denied the plaintiff's pleadings as regards clarity of authorization in the name of defendant no. 1 to receive rent.
6. Plaintiff filed replications to the above written statements, reiterating the plaint contents. It would be apposite to record that Suit No. 209562/2016 Diwakar Enterprises vs Alamdeep Singh & Ors. Page 6 of 9 Pages although replication to the written statement of defendants no. 13 is on record but written statement of the said defendants is not on record. Upon detailed examination of the proceedings, it is revealed that when the suit was pending in the Hon'ble Delhi High Court, as reflected from the noting of the dealing assistant on order sheet dated 11.09.2015, written statement of defendants no.13 was lying in objections with the registry and it appears that the objections were not got removed but on the basis of advance copy, plaintiff filed replication to the said written statement.

Before the completion of pleadings in the present suit, defendants were successful in resolving their interse disputes and all of them made a statement in this court personally or through affidavits that they have no objections if the entire rent pertaining to the suit property is paid by plaintiff to the present defendant no. 1.
8. It is under these circumstances that on account of interse settlement between the defendants, both sides submitted today that there is no issue of facts or law required to be framed and final arguments can be heard today itself.
9. Under these circumstances, I have heard Shri Praveen Kumar, learned counsel for plaintiff and Ms. Priyanka Garg, learned counsel for defendants, who took me through records. It is argued on behalf of defendants that there was never any confusion as regards the Suit No. 209562/2016 Diwakar Enterprises vs Alamdeep Singh & Ors. Page 7 of 9 Pages person entitled to receive rent after death of the now deceased landlord, so the present suit was not even called for. Learned counsel for plaintiff argued that the contents of written statements of defendants clearly reflects that there were disputes between the defendants interse and that being so, plaintiff was constrained to file this suit.

In view of the contents of written statements of defendants which have been traversed through above, it is clear that defendants were litigating against each other on the issue of inheritance of estate left behind by the now deceased landlord. As further reflected from pleadings and documents, different defendants were claiming different shares in the rent payable qua the suit property. That being so, it is not correct to say that there was no confusion as regards identity of the person entitled to receive rent. However, as discussed above, now the defendants have resolved their interse disputes related to inheritance and have agreed that defendant no. 1 be allowed to receive rent of the suit property from plaintiff.
11. However, at request of both sides, it is clarified that none of the above observations shall be read to the prejudice of either side in the pending suit for recovery of possession of the suit property and mesne profits.

In view of above discussion, the present suit succeeds and is decreed in favour of plaintiff, declaring that defendant no. 1 Shri Alam Suit No. 209562/2016 Diwakar Enterprises vs Alamdeep Singh & Ors. Page 8 of 9 Pages Deep Singh Mundi, who is the legal heir of late Lt. Gen. Ajit Singh, is entitled to receive rent for the suit property and also declaring that plaintiff is entitled to indemnification with respect to the claims for rent of the suit property.
13. Decree sheet be accordingly drawn and file be consigned to records leaving the parties bear their own costs.
