O R D E R
(Per: Shri Rajinder Singh Dogra, Judicial Member) Miscellaneous Application No. 244/2026 The present Miscellaneous Application filed by the applicants under Rule 4(5) of the Central Administrative Tribunal (Procedure) Rules, 1987, seeking permission to join and pursue the Original Application (O.A.) collectively, is allowed.
Accordingly, the applicants are hereby granted permission to join and proceed with the Original Application collectively. Original Application No. 245/2026 The present Original Application has been filed by the applicant under Section-19 of the Administrative Tribunals Act, 1985 seeking the following reliefs:-
"i. Allow this Original application of the applicant; ii. Quash/set-aside the impugned circular bearing No. IFCJ/ESTAB/29320-351 dated 20-02-2026 issued by respondent No.2 vide which process of conduct of type test has been initiated without first allowing consideration to the promotion of already qualified candidates including the applicants herein for the available posts of Junior Assistant;
iii. Direct the respondents to immediately conduct the DPC and allow consideration to all the eligible/qualified candidates including the applicants against the post of Junior Assistant in view of settled norms and procedure of allowing such consideration to the qualified candidates till the list of 43 qualified left-over candidates gets exhausted;
iv. Restrain the respondents from allowing benefit of promotion to any candidate till the list of leftover 43 eligible candidates who have qualified type test in the year 20023 is exhausted;

No. 61/245/2026 Any other relief which this Hon'ble Tribunal may deem just and proper in the given facts and circumstances of the case may also be passed in favour of the applicant and against the respondents."
2. Learned counsel for the applicants submitted that the applicants have challenged Circular No. IFSJ/FSTAS/29320-351 dated 20-02-2026 issued by Respondent No. 2, which directs DDOs to submit lists of computer-proficient Class-IV (matriculate) employees with fees for a type test required for promotion to the post of Junior Assistant.
3. Further, he contends that despite the applicants and others already qualifying this test and awaiting promotion, the circular allows previously failed candidates a retest, potentially giving them undue advantage over the qualified applicants. This violates departmental norms, which prioritize promoting qualified MTS candidates before conducting new tests, thereby depriving the applicants of their rightful consideration.

Learned counsel for the applicants further submitted that the applicants would be satisfied if this OA is disposed of with the direction to the respondents to treat this OA as representation of the applicants for considering their cases for promotion to the post of Junior Assistant as they all have already qualified the type test; and decide their case within a stipulated timeframe.

5. Keeping in view the limited prayer made by the applicants' counsel we deem it appropriate to dispose of the instant Original Application with the direction to the respondents to treat this OA as representation of the applicants and consider their cases for promotion to the post of Junior Assistant as being qualified for the type test, in the light of settled rule position before proceeding further.
6. Respondents are further directed to bear in mind the seniority-cum-merit and the prevalent norms and procedures, before promoting any person; and the senior and qualified candidates shall be given the priority.
7. The respondents shall pass a reasoned and speaking order after considering the case of the applicant and communicate a copy of the order so passed to the applicant.
8. The whole exercise should be undertaken within a period of six weeks.
9. With this, OA stands disposed of. No costs.
