Facts:­ 

1. Applicant  submitted  RTI  application  dated  8 May  2010   before   the   CPIO,   office   of   the   Income   Tax  Officer, Jalore seeking information pertaining to the  income tax returns of third­party and proposed action  to   be   taken   against   the   said   party   based   on  information provided by the appellant.

2. Vide CPIO order dated 14 May 2010, disclosure of  information   was   denied   on   the   grounds   that   it   was  personnel   to   the   third­party   and   also   the   that   the  appellant   had   not   demonstrated   any   larger   public  interest in disclosure.

3. Applicant   preferred   appeal   dated   25   May   2010  before the first appellate authority.

4. Matter was decided vide FAA order dated 18 June  2010 vide which the order of the CPIO was upheld.

5. Applicant   preferred   second   appeal   before   the  Commission.   Matter   was   heard   today   through  Appeal : No. CIC/DS/A/2011/000036   2 videoconferencing.   Appellant   did   not   appear.  Respondent   was   present   as   above   and   heard   from  Jalore. Appeal is dismissed.

6. Commission   has   heard   the   averments   of   the  respondent   and   also   on   the   basis   of   the   facts   on  record, Commission upholds the order of the CPIO and  the   first   appellate   authority.   In   case   appellant  wishes   to   provide   information   to   the   Department,   he  is  free to  prefer  a separate   TEP as RTI  application  is   not   the   appropriate   format   to   do   so.   Appeal   is  dismissed.
