3 20-07-2017Heard learned counsel for the parties.
This application for anticipatory bail arises out of Bodh Gaya P.S. Case N0. 199 of 2017, disclosing offences under Sections 109, 147, 148, 149, 188, 323, 325, 333, 338, 341,353, 354B, 427,506 of the Indian Penal Code and Section 72 of the Bihar Police Act, 2007 and Section 4 of the Damage of Property Act, 1984.
Learned counsel for the petitioner has submitted that except that the petitioner was addressing a gathering with the use of Loud Speaker, there is no allegation against him. It transpires from the First Information Report that the mob had caused obstruction on movement of vehicular traffic on a road in protest against the local administration.
Learned counsel for the petitioner has drawn my 2 attention to an order of this Court dated 06.07.2017, whereby some other co-accused persons have been granted anticipatory bail.
Considering the above submissions, this application is allowed.
Let the petitioner above named in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in Bodh Gaya P.S. Case No. 199 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
