This is an appeal by the assessee against the order dated 22nd March, 2004 of learned CIT(A)-III, New Delhi.
2. During the course of hearing, the learned counsel for the assessee submitted that he has instructions to withdraw this appeal and gave in writing as under :-
"The above mentioned appeal is fixed for hearing before your Honours today.
In this regard, it is respectfully submitted that since there is no tax consequence in the aforesaid appeal, therefore, on instruction of client, we wish to withdraw the said appeal. The assessee may accordingly be allowed to withdraw the appeal.
2 ITA-2655/Del/2004 We trust that our request shall be acceded to. The appellant will be grateful for this kindness."
3. Learned Senior DR did not object if the appeal of the assessee is to be dismissed as withdrawn.
4. In view of the above, the appeal of the assessee is dismissed as withdrawn.
5. In the result, the appeal of the assessee is dismissed.
