1. The issues under consideration arising out of the second appeal dated 17.06.2019 include non-receipt of the following information sought by the appellant through the RTI application dated 29.03.2019 and first appeal dated 08.05.2019:-

"भारत सरकार ने धानमं ी आवास योजना के तहत शहरी े म डीएचएफएल कं पनी से MIG-1, MIG-2, MIG एवं LIC क क म के तहत 01.05.2016 से लेकर 31.12.2017 तक िजन !ाहक" को सि$सडी िमली है उन सभी !ाहक" का पूरा नाम, उनका रा(य एवं घर का पूरा पता और घर के पुरे े फल क जानकारी एवं लोन कोड नंबर, उनक सलाना यानी वा,षक आय, उनको सि$सडी िमलने क ितथी और सि$सडी /कतनी िमल उसक जानकारी दी जाए"

Succinctly facts of the case are that the appellant filed an application dated 29.03.2019 under the Right to Information Act, 2005 (RTI Act) before the Central Public Information Officer (CPIO), National Housing Bank, New Delhi, seeking aforesaid information. The CPIO vide letter dated 01.05.2019 replied to the appellant. Dissatisfied with the same, the appellant filed first appeal dated 08.05.2019. The First Appellate Authority (FAA) vide order dated 04.06.2019 disposed of the first appeal. Aggrieved by the same, the appellant filed a second appeal dated 17.06.2019 before the Commission which is under consideration.

3. The appellant has filed the instant appeal dated 17.06.2019 inter alia on the grounds that reply given by the CPIO was not satisfactory. The appellant requested the Commission to direct the CPIO to provide the complete information and take necessary action as per Section 20 (1) of the RTI Act.

4. The CPIO replied vide letter dated 01.05.2019 and the same is reproduced as under :-

"रा0ीय आवास ब1क 2ारा वांिछत फॉम5 म जानकारी जनरेट नही क जाती है । /दनांक (?) से (?) क अविध के दौरान दीवान हाउ;सग फाइन स कॉरपोरेशन िलिमटेड (डीएचएफएल) के उधारकता5 क वत5मान सूची, िजनके िलए पीएमएवाई-सीएलएसएस को रा.आ. ब1क 2ारा क >ीय नोडल एज सी के ?प म संिवत@रत /कया गया है, संलA है ।"

The FAA vide order dated 04.06.2019 agreed with the view of CPIO.

5. The appellant attended the hearing through audio and on behalf of the respondent Shri V.Rajan, CPIO & General Manager, Shri Anuj Rastogi, Dy. General Manager and Shri Sanjeev Kumar Singh, Manager, National Housing Bank, Delhi attended the hearing in person.

5.1. The appellant inter alia submitted that he had sought details of beneficiaries of MIG-I,MIG-II,MIG and LIG scheme in urban areas, who availed subsidy from DHFL Page 2 of 4 between the periods of 01.05.2016 to 31.12.2017 including the area of the house, annual income, etc. 5.2. The respondent while defending their case and while endorsing their reply dated 01.05.2019 inter alia submitted that the details of beneficiaries under Deewan housing scheme was sought by the appellant. The list of beneficiaries who had received the subsidy under PMAY-CLSS scheme under MIG-I, MIG-II & EWS/LIG category of the relevant period along with loan codes and subsidy amounts were provided to the appellant on receipt of charges of Rs. 148/-.

The Commission after adverting to the facts and circumstances of the case, hearing both the parties and perusal of records, observed that due reply was given by the CPIO on 01.05.2019 and by the FAA on 04.06.2019. The information for the material period being provided, there appears to be no further public interest in further prolonging the matter. Accordingly, the appeal is dismissed.

Copy of the decision be provided free of cost to the parties.
