      Petition under Article 226 of the Constitution of India praying that in the
circumstances stated in the affidavit filed therewith, the High Court may be
pleased to issue a writ, order or direction more particularly one in the nature
of WRIT OF MANDAMUS declaring the inaction on the part of Respondents
more particularly Respondent Nos. 4 and 5 on petitioners representation,
dated 14.07.2025, submitted for granting police aid            pursuant to the
permanent injunction decree and Judgment dt. 13.10.2017 on the file of
learned 1st Addl. Junior Civil Judge, Chittoor for preventing the 6th
Respondent and his men from causing continuous nuisance at our property
admeasuring Ac. 5.41 Cents covered by Sy. No. 478 including terraced
residential building, an asbestos sheet roofed church situated in Penumuru
Revenue Village and Mandal, Chittoor District as illegal, irregular, irrational
and     amounts to non-discharge of legal obligation conferred on the
Respondents and offends Articles 14, 21 and 300-A of the Constitution of
India and consequently direct the Respondents more particularly Respondent
Nos 4 and 5 to grant police aid to petitioner for preventing Respondent and
his men from causing continuous nuisance at said property by considering
said representation and pass such

ORDER:

This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:

"...pleased to issue a writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the inaction on the part of Respondents more particularly Respondent Nos. 4 and 5 on petitioners representation, dated 14.07.2025, submitted for granting police aid pursuant to the permanent injunction decree and Judgment dt. 13.10.2017 on the file of learned 1st Addl. Junior Civil Judge, Chittoor for preventing the 6th Respondent and his men from causing continuous nuisance at our property admeasuring Ac. 5.41 Cents covered by Sy. No. 478 including terraced residential building, an asbestos sheet roofed church situated in Penumuru Revenue Village and Mandal, Chittoor District as illegal, irregular, irrational and amounts to non-discharge of legal obligation conferred on the Respondents and offends Articles 14, 21 and 300-A of the Constitution of India and consequently direct the Respondents more particularly Respondent Nos. 4 and 5 to grant police aid to petitioner for preventing Respondent and his men from causing continuous nuisance at said property by considering said representation and pass such...."

2. Heard Sri Pala Karthi Kiran, learned counsel for the petitioner and Sri V.Farooq, learned Assistant Government Pleader for Home for the respondents.

3. Learned counsel for the petitioner would submit that the petitioner has filed a civil suit in O.S.No.291 of 2010 on the file of I Additional Junior Civil Judge, Chittoor which was allowed. Aggrieved thereby, the unofficial respondent herein preferred First Appeal in A.S.No.148 of 2017 on the file of Principal District Judge, Chittoor, that was dismissed. Then the unofficial 4 respondent, having suffered the First Appeal, preferred Second Appeal in S.A.No.264 of 2024 before this Court which was also dismissed. The petitioner has made a representation to the police and that is pending before the police. Learned counsel would further submit that let there be a direction to attend the case of the petitioner in the light of the decrees passed by the Trial Court which was confirmed in First appeal and also in Second appeal.

4. Learned Assistant Government Pleader for Home would submit that the Court may pass appropriate orders.

5. In that view, the Writ Petition is disposed of. However, the police are directed to consider the representation of the petitioner and take appropriate steps according to Governing Rules and law. No order as to costs.

As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed.
