This application having been heard on 03rd September, 2013, this Tribunal on the
same day delivered the following :-
O R D E R
BY HON'BLE Dr.K.B.S.RAJAN, JUDICIAL MEMBER
1. As the two cases are identical in nature, theses two O.As are dealt with in this common judgment.
2. As a matter of fact, both the cases are identical to the facts contained in another OA No. 632 of 2012 and the prayer in this O.As is also identical.
3. The said OA No. 632 of 2012 was recently decided vide order dated 8th July, 2013 wherein the following order was passed:-
"This application has been filed by the Indian Space Research Organization Senior Citizen's Forum represented by its President and ten others.
2. The grievance of the applicants in this Original Application is that the benefit available to the petitioners in Writ Petition Civil No.31525/2004 vide judgment dated 18th January, 2007 (Annexure A-8) has not been made to percolate upon the applicants on the ground, vide the impugned Annexure A-12 order, that the orders of the Hon'ble High Court and Hon'ble Supreme Court do not direct that the judgment should be extended to non-applicants as well. Hence, the following reliefs are sought by the applicants.
i) Call for the records leading to the issue of Annexure A12 an set aside A-12.
ii) Direct the respondents to extend the benefit of Annexure A8 judgment to the applicants.
iii)Declare that similarly situated persons to the petitioners in Annexure A8 judgment are also entitled for the benefits of Annexure A7 judgments.
iv) Call for the records leading to the issue of Annexure A12 and direct the respondents to give the following benefits to the applicants:-
a) Count the additional increments sanctioned vide DOS OM dated 3.2.1999 as pay for all payments like DA, HRA, Pension and other pensionary benefits as has been paid to the petitioners in the aforesaid Writ Petitions (C) Nos 29358, 29710 and 31525 of 2004.
b) Pay professional update allowance payable in terms of para 3 of the DOS OM dated 3.2.99 from 1998-1999 falling due on 1.4.99 onwards as was paid to the petitioners in the aforesaid writ petitions.
v) Any other further relief or order as this Hon'ble Tribunal may deem fit and proper to meet the ends of justice.

Briefly stated, the Government of India had afforded certain incentives to the Scientists/Engineers in the Department of Space/ISRO as per which a Special Pay of Rs.2000/- per month effective from 1.1.1996 in the grades of Scientists D, E, F & G were given. In addition, two additional increments with effect from 1.1.1996 after normal pay fixation were also made available and further a Professional Update Allowance of Rs.5000/- per annum were granted to all such Scientists (Annexure A-3 refers). Subsequently, the substantial alterations to Annexure A-3 in the guise of clarification were made vide Annexure A-4, whereby a Special Pay of Rs.2000/- was to be counted for fixation of pay on promotion to the higher grade, whereas the additional increments granted to the Scientists in the grade of Scientists D,E,F & G would not be taken into account for fixation of pay on promotion. As per the said clarifications, neither the Special Pay granted to Scientists/Engineers-'H', nor increments granted to the Scientists/Engineers D,E,F & G were counted for the purpose of DA, HRA, Pension etc. There was modification in respect of all Professional Update Allowance also vide Annexure A-5.

Aggrieved by the Annexure A-4 order dated 12.08.1999, a few employees and retirees of ISRO Centres located in Trivandrum filed Original Application Nos.808/2001, 843/2001 and 1080/2001 before this Bench for quashing the aforesaid Annexure A-4 & Annexure A-5 orders. Similarly, as to the issue relating to the Special Pay of Rs.2000/- (Annexure A-4) , O.A No.1153/2002 was filed before the Principal Bench by certain other individuals. In that O.A, the claim was for treating the Special Pay of Rs.2000/- per month as part of pay for computing pension/retiral benefits with all consequential benefits. The Tribunal allowed the said Original Application and set aside Annexure A-4 to the extent of non-inclusion of special pay as part of pay for the purpose of such pension. This order was implemented by the Department of Space vide order dated 11 July 2003. This Order was not confined to the applicants in the aforesaid O.A before the Principal Bench, but extended to all similarly situated persons without forcing the similarly situated persons to approach the Court of law.

The O.A Nos. 808/2001, 843/2001 and 1080/2001 before this Bench came to be dismissed vide order dated 02nd July 2004 against which Civil Writ Petition No.29358, 29710 and 31525 of 2004 were filed before the Hon'ble High Court of Kerala. The Hon'ble High Court allowed these writ petitions making it clear that the additional increments sanctioned in terms of para 2 of the O.M dated 03.02.1999 (Annexure A-3) shall be counted as pay to attract all further applicants including pension depending on the pay of an incumbent and that Professional Update Allowance payable in terms of order dated 03.02.1999 shall be payable from 1998-99 falling due on 01.04.1999 onwards (Annexure A-8 judgment refers).
6. The aforesaid judgment was subjected to a Review Petition before the Hon'ble High Court vide R.P 416, 422 & 423 of 2007, but were dismissed by the Hon'ble High Court by order dated 16.07.2007.
7. Attempt by the respondents to challenge the judgment of the Hon'ble High Court before the Hon'ble Supreme Court was also a failure as the Apex Court in SLP Civil No.555-560/2008 dismissed vide order dated 04.04.2011 at Annexure A-9.
8. Pursuant to the dismissal of the SLP and the Review Petition, the order of the Hon'ble High Court were implemented by the respondents in respect of the petitioners before the Hon'ble High Court. Thus unlike in the case of extension of the order of the Principal Bench in respect of special allowance to all similarly situated persons, the respondents have restricted the benefit of the judgment in the writ petition only to the petitioners without extending the same to other similarly situated. When the applicants approached the administration in respect of the same, the impugned order vide Annexure A-12 has been passed. It is against the same that the applicants have filed this Original Application seeking the above reliefs.

Counsel for the applicants argued that the matter is one relating to inclusion of additional allowance as pay for all purposes including increments and the matter thus, is one of common in character, applicable to all and not pertaining to the applicants in the concerned OA or petitioners before the High Court alone. Again, as in the case of Special Allowance, which was directed by the Court to be paid, the respondents had paid the same not only to the applicants therein but also to all similarly situated. Similarly, in the instant case also, the judgment of the High Court as upheld by the Apex court should be implemented not only with respect to the petitioners before the High Court but to all who are similarly situated. The counsel further argued that in fact, the Hyderabad Bench of the Tribunal has referred to the decision of the Kerala High Court and held that the benefit should percolate to all. In this connection, the applicants have already annexed a copy of the order dated 23-04-2012 in O No. 1158 of 2012 by way of an M.A. No. 700 of 2013. Thus, the counsel argued that there is no justification in confining the benefits of the judgment of the High Court in WP No. No.29358, 29710 and 31525 of 2004 to the petitioners therein alone but the same should be extended to all similarly situated.

Counsel for the respondents submitted that the claim of the applicants has not been entertained by the Administration as the decision of the High Court was implemented only with reference to the petitioners therein as no specific order has been passed either by the High Court or the Apex Court to extend the benefits to all.
11. Arguments were heard and documents perused. That the judgment of the High Court has been implemented to the petitioners therein is not in dispute. That the applicants are similarly situated is also not disputed by the respondents. The question, therefore, is whether the benefit of the said judgment could be extended to other similarly situated including the applicants. The Order dated 23-04-2013 of the Hyderabad Bench of the CAT in OA No. 1158 of 2012 dealt with the legal issue in para 2 of the order and the same is as under:-
2. The only ground on which the case of the present applicants was not considered was of they being not parties to the litigation. In our opinion, that cannot be a ground for rejecting the claim of the applicants. .....
3. Learned counsel for the respondents relied upon a decision of the Hon'ble Supreme Court in Shiv Dass Vs. Union of India & Others reported in AIR 2007 SUPREME COURT 1330 claiming that the Hon'ble Supreme Court held that in cases of this nature where pensionary benefits are claimed belatedly, the normal time for claiming the same is three years. A reading of the above judgment of the Hon'ble Supreme Court makes it clear that there need not be always adherence to the rule of three years.

In this particular case, the judgment of the Hon'ble Kerala High Court is dated 18.1.2007 and the judgment of the Hon'ble Supreme Court is dated 4.4.2011 and that was said to be implemented on 21.11.2011. such being the case and considering the fact that the matter relates to pay and allowances and pension of retired employees, we are not inclined to interpret the limitation rule of 3 years against the applicants.
5. O.A. is accordingly allowed. The members of the 1st Applicant as per Annexure XIII and the applicants 2 & 3 are entitled for all the benefits in terms of the judgment of the Kerala High Court in W.P.(C) No.29358, 29710 & 31525 of 2004. the order shall be complied with within three months from the date of receipt of copy of this order.
12. The Tribunal fully endorses the view of the Hyderabad Bench in the above case. In addition, the following decisions of the Apex Court and the recommendation of the V CPC would support the case of the applicants:-
(a) Inder Pal Yadav v. Union of India, (1985) 2 SCC 648, the Apex Court has held as under:-
"... those who could not come to the court need not be at a comparative disadvantage to those who rushed in here. If they are otherwise similarly situated, they are entitled to similar treatment, if not by anyone else at the hands of this Court.
(b)The Apex Court as early as in 1975 in the case of Amrit Lal Berry v. CCE, (1975) 4 SCC 714 , held as under:-
We may, however, observe that when a citizen aggrieved by the action of a government department has approached the Court and obtained a declaration of law in his favour, others, in like circumstances, should be able to rely on the sense of responsibility of the department concerned and to expect that they will be given the benefit of this declaration without the need to take their grievances to court.
(c) The V Central Pay Commission in its recommendation, in regard to extension of benefit of court judgment to similarly situated, held as under:-
"126.5 - Extending judicial decisions in matters of a general nature to all similarly placed employees. - We have observed that frequently, in cases of service litigation involving many similarly placed employees, the benefit of judgment is only extended to those employees who had agitated the matter before the Tribunal/Court. This generates a lot of needless litigation. It also runs contrary to the judgment given by the Full Bench of Central Administrative Tribunal, Bangalore in the case of C.S. Elias Ahmed and others v. UOI & others (O.A. Nos. 451 and 541 of 1991), wherein it was held that the entire class of employees who are similarly situated are required to be given the benefit of the decision whether or not they were parties to the original writ. Incidentally, this principle has been upheld by the Supreme Court in this case as well as in numerous other judgments like G.C. Ghosh v. UOI, [ (1992) 19 ATC 94 (SC) ], dated 20-7-1998; K.I. Shepherd v. UOI [(JT 1987 (3) SC
600)]; Abid Hussain v. UOI [(JT 1987 (1) SC 147], etc. Accordingly, we recommend that decisions taken in one specific case either by the judiciary or the Government should be applied to all other identical cases without forcing the other employees to approach the court of law for an identical remedy or relief. We clarify that this decision will apply only in cases where a principle or common issue of general nature applicable to a group or category of Government employees is concerned and not to matters relating to a specific grievance or anomaly of an individual employee."
13. The above judicial decisions and the recommendations of the Pay Commission do support the case of the applicants. In view of the same, the OA deserves to be allowed. We order so. It is declared that those applicants who are all similarly situated as the petitioners in the Writ Petition (c) No. 31325 of 2004(S) and other connected matters, are entitled to the benefits provided for in DOS OM dated 03-02-1999 i.e. the additional increments sanctioned would count as pay for all payments like DA, HRA, Pension and other pensionary benefits. Likewise, the professional update allowance payable in terms of Paragraph 3 of the DOS OM dted 03-02-1999 from 1998-99 falling due on 01-04-1999 onwards as was paid to the petitioners in the aforesaid writ petitions would also be payable to the applicants. Necessary orders, including issue of revised PPO be passed within a period of four months from the date of communication of this order. No costs. "
4. Counsel for the applicants submitted that in view of the fact that the cases in hand are identical to that in OA No. 632 of 2012, the same order could well be followed in these two cases as well.
5. Counsel for the respondents has not refuted the fact that all these cases are identical.
6. In fact, in the said OA No. 632 of 2012, referring to decision of the Apex Court in the case of Amrit Lal Berri etc., and also quoting paragraph 126.5 of the Recommendations of the V Central Pay Commission, it was held that the benefits available to the applicants in OA No. 632 of 2012 should be made available to all other similarly situated persons without driving them to approach judicial forum. If that order is implemented in spirit and intent, the two cases would also be the beneficiaries. Nevertheless, since the applicants are before the Tribunal, these two cases are also decided on the same lines as in OA No. 632 of 2012.
7. Accordingly the O.As are allowed. It is declared that those applicants, who are all similarly situated as the petitioners in the Writ Petition (c) No. 31325 of 2004(S) and other connected matters, are entitled to the benefits provided for in DOS OM dated 03-02-1999 i.e. the additional increments sanctioned would count as pay for all payments like DA, HRA, Pension and other pensionary benefits.
Likewise, the professional update allowance payable in terms of Paragraph 3 of the DOS OM dated 03-02-1999 from 1998-99 falling due on 01-04-1999 onwards as was paid to the petitioners in the aforesaid writ petitions would also be payable to the applicants.
