This is the second petition filed by the petitioner for the grant of regular bail, the first one having been dismissed as withdrawn on 22.7.2014.

As per the prosecution, the petitioner was found in possession of 70 grams of intoxicating powder while his co- accused Balwant Kaur was having 55 grams of intoxicating powder in her possession. The sample of the contraband, on chemical analysis, was found to contain diphenoxylate as its active ingredient.

Apart from the aforementioned heavy recovery, the petitioner is involved in two more cases, one under Section 21 of AJAY KUMAR 2014.10.01 17:23 I attest to the accuracy and authenticity of this document Chandigarh CRM M-32935 of 2014 -2- the Narcotic Drugs and Psychotropic Substances Act while the other under Section 61 of the Excise Act. His co-accused Balwant Kaur, who was not shown to be involved in any other case, was granted the concession of bail by this Court vide order dated 22.7.2014.

In view of the aforementioned recovery and the chequered past of the petitioner, no ground is made out to grant him the concession of bail.

The petition is without any merit and, therefore, dismissed.
