This is the third petition filed under Section 483 r/w Section 528 of BNSS, 2023 for extension of interim regular bail granted in FIR No.25 dated 29.03.2024 under Sections 18/61/85 of NDPS Act and 61/1/14 of Excise Act registered at Police Station Bassi Pathana District Fatehgarh Sahib.

Learned counsel for the petitioner contends that the petitioner was taken in custody after recovery of 4.5 kg opium and 760 litres of lahan from the house of petitioner at village Bilaspur on 30.03.2024. He contends that the petitioner, aged 72 years, is suffering from various health issues including Umbilical Hernia. He, thus, moved an application for interim bail bearing CRM-M-66335-2025. Medical status of the petitioner was called from the jail authorities, which was received confirming that the petitioner is suffering with the disease i.e. Umbilical Hernia. Interim bail was thus, granted to the petitioner for a period of three weeks vide order dated 23.01.2026 (Annexure P-5). The petitioner thereafter consulted at Aman Hospital at Morinda road, SONIA BURA 2026.02.16 17:57 I attest to the accuracy and integrity of this document CRM-M-8772-2026 -2- Chunni Kalan, District Fatehgarh Sahib but the doctors have not given any specific date for surgery and have advised insulin twice a day for three to four months so as to regulate blood sugar. Learned counsel contends that as a result of the doctor having extended the period of surgery, the interim bail granted to the petitioner be extended.
3. I have heard learned counsel for the petitioner and have gone through the documents annexed with the petition.

While this Court would be sympathetic on account of the medical condition of the petitioner and going by his age, the medical condition itself cannot be a way to seek substitution of regular bail by way of seeking regular extensions of interim bail on medical grounds. The pleadings raised by petitioner contending that he is required to administer insulin twice a day for three to four months and not specifically for carrying out any surgery has been assigned by the private doctor before whom the petitioner is appearing for seeking treatment. The same is the medical course required to be completed by the petitioner before any surgery can be conducted, there is no reason for extension of interim bail granted to the petitioner as such medication can also be provided to him while being in jail. It is, however, directed that the jail authorities shall keep a regular follow up of medical status of the petitioner and extend the medical facilities for the medical condition i.e. Umbilical Hernia. The State shall also obtain a report from Rajinder Hospital, Patiala as to whether the treatment of Umbilical Hernia is available in the said Hospital or not and shall produce the petitioner before the authorities for follow up and medical advice.

Finding no valid ground for extending the interim bail, present petition is dismissed with the directions as aforesaid.
