7. Xन 1 का उZर दे खे A written submission has been received from Dr. Hemant Kumar, Deputy Health Officer, City SP Zone, vide letter dated 30.09.2024, a copy of which has been sent to the Complainant/Appellant and the same has been taken on record. The relevant extract of the same is as under:
"In reference to the direction given by Hon'ble CIC vide order no CIC/MCDND/C/2023/146612 dated 24.09.2024 in connection with above RTI application it is submitted that:
Sh. Sanjay Dayal had filed an application under RTI ACT in the City SP Zone on dated 13.06.2023 and which received in the office of PIO/DHO/CSPZ on dated 15.06.2023 vide dairy no 1831/DHO/CSPZ.
In his application Sh. Sanjay Dayal sought information about E-Cart policy of erstwhile North DMC. The reply of the above RTI was given by the PIO/CSPZ vide letter no DHO/CSPZ/2023/D- 787 dated 05.07.2023 (Copy attached for reference) As per record provided by the applicant he states that he has deposited Rs. 10 vide G8 no 7928174 and given application to PIO/DHO/CSPZ to provide copy of order no Addl.MHO/2020/D- 291 dated 21.09.2021 which was received in the office of DHO on dated 25.10.2023 vide dairy no 9091. The reply of the above application was given by the PIO/DHO/CSPZ vide letter no DHO/CSPZ/2023/D-1320 dated 20.11.2023 (Copy attached).
Notice of the second appeal received on dated 27.09.2024 in this regards it is submitted that PIO/DHO/CSPZ also sent copy of reply of second appeal to the appellant."

Being dissatisfied, the appellant filed a First Appeal dated 16.03.2023. The FAA vide its order dated 12.04.2023, held as under.
The case was heard on 12.04.2023. The appellant sought the information regarding P.No. 2229-2232, Futa Road, Teliwara, Sadar Bazar, Delhi and stated that pointwise correct information not furnished by the PIO. PIO informed that the reply has been sent to the appellant vide No D/EE(B)/CSPZ/2023/1323 dated 18.02.2023. The PIO is hereby directed to provide the amended/pointwise reply as per the content of the RTI to the appellant within 10 days positively.
In compliance to FAA's order PIO/Executive Engineer vide letter dated 09.05.2023 provided the relevant information to appellant which is as under:

The PIO is hereby directed to provide the amended/pointwise reply as per the content of the RTI to the appellant within 10 days positively.
The present appeals stand disposed off with aforesaid directions.
In compliance to FAA's order PIO/Executive Engineer vide letter dated 09.05.2023 provided the relevant information to appellant which is as under:
1. As per available records, the complaint dated 09.05.2022 has been marked to the then area JE (B) for necessary action and till date no action has been taken.

Being dissatisfied, the appellant filed a First Appeal dated 24.05.2023. The FAA vide its order dated 20.06.2023, held as under.
The appellant sought the information through the RTIs and informed through Appeal application that he has not received reply from the PIO. During the course of hearing PIO informed that the reply of the RTIs have been sent to the appellant vide above dispatch numbers. During the discussion in the hearing appellant has raised the issue that the replies furnished by the PIO is not as per the content of the RTIs points. The PIO is hereby directed to provide the amended pointwise reply as per the content of the RTIs application to the appellant as per record within 10 days positively.
The appeal stands disposed off with aforesaid directions.

1 No such information is available in the records of PIO. However, at present the following officers are supervising the area which is mentioned in the RTI.
1. Sh. Rajesh Sharma, AE(B)/CSPZ and
2. Sh. Shiv Shakti, JE (B)/CSPZ 2 Future correspondence does not comes under the preview of RTI Act-
2005.
3 As per available record the P. No. 1401-1402, Pan Mandi, Sadar Bazar, Delhi-05 has been booked vide F. No. 183/B/UC/SPZ/2015 Dt. 22.06.2015 as per DMC Act in the records of PIO. However, the details of Sanctioned Building Plan/ Action Taken Report/ Booking of unauthorized Construction is available on MCD website i.e. www.mcdonline.nic.in., so you can inspect the above mentioned site and obtained the available records.
4 The applicant is requested to visit the office of the undersigned and inspect the concerned register maintained in this office and obtain the Page 11 of 38 copy of the desired information after paying the requisite fee @ Rs. 2/-
per copy as per RTI Act-2005.

1 No such information is available in the records of PIO. However, at present the following officers are supervising the area which is mentioned in the RTI.
1. Sh. Rajesh Sharma, AE(B)/CSPZ and
2. Sh. Shiv Shakti, JE (B)/CSPZ 2 Future correspondence does not comes under the preview of RTI Act-
2005.
3 As per available record the P. No. 1401-1402, Pan Mandi, Sadar Bazar, Delhi-05 has been booked vide F. No. 183/B/UC/SPZ/2015 Dt. 22.06.2015 as per DMC Act in the records of PIO. However, the details of Sanctioned Building Plan/ Action Taken Report/ Booking of unauthorized Construction is available on MCD website i.e. www.mcdonline.nic.in., so you can inspect the above mentioned site and obtained the available records.
4 The applicant is requested to visit the office of the undersigned and inspect the concerned register maintained in this office and obtain the copy of the desired information after paying the requisite fee @ Rs. 2/-
per copy as per RTI Act-2005.

Being dissatisfied, the appellant filed a First Appeal dated 04.09.2023. The FAA vide its order dated 27.09.2023, held as under.

Being dissatisfied, the complainant filed a First Appeal dated 03-02-2024. The FAA vide its order dated 03-02-2024, held as under.
The case was heard on 16.08.2023. No reply sent by the PIO till date. The PIO/EE(B)-I is hereby directed to provide the reply as per the content of the RTI to the appellant within 10 days positively. The present appeal stands disposed off with aforesaid directions.
Being dissatisfied, the complainant the complainant failed to file a First Appeal. Feeling aggrieved and dissatisfied, complainant approached the Commission with the instant Complaint.
Relevant Facts emerged during Hearing:
The following were present:-
Complainant: Present in person.
Respondent: Shri Ashok Kumar, Public Health Inspector, Shri RK. Garg, APIO- cum-Assistant Engineer (Building), Shri Hanumant Trivedi, CPIO-cum-Assistant Engineer (Building), Shri Vivek Jaidka, SO and Shri Ravi Sharma, ASO, attended the hearing in person.
The Complainant/Appellant stated that he is not satisfied with the reply provided by the Respondent qua the instant RTI Applications.
The Respondent submitted that all the RTI Applications filed by the Complainant/Appellant has been duly replied in terms of RTI Act. He further Page 35 of 38 apprised the bench in all the cases, the directions passed by the First Appellate Authority have duly been complied with. He added that Complainant/Appellant is a habitual RTI Applicant and in the last one year, he has filed more than 80 RTI Applications in their office.
The Complainant/Appellant intervened and informed the bench that out of total 22 cases listed for hearing today, he wants to withdraw cases bearing No. CIC/MCDND/C/2024/101916 and CIC/MCDND/A/2023/143097 and does not want to press 18 Second Appeals/Complaints other than case file bearing No. CIC/MCDND/A/2023/141104.
Decision The Commission after adverting to the facts and circumstances of the case, hearing both the parties and perusal of the records, observes that suitable replies in terms of RTI Act have been provided by the Respondent in all the cases.
Be that as it may, the Commission further observes from the perusal of records that more than 40 cases of the same Complainant/Appellant against same Public Authority have already been heard and disposed of by different benches of the Commission. In this regard, it is also worth noting that a total number of 22 Second Appeals/Complaints cases including the present set of cases listed for today's hearing and the same have been heard together simultaneously.
The Complainant/Appellant has filed numerous RTI Applications seeking similar information in each of his RTI Applications with minor changes apparently to pressurize the Public Authority rather than actual interest in getting the information. This intention of the Complainant/Appellant militates against the spirit of the RTI Act whose primary objective is providing information to the citizens. It appears that the Complainant/Appellant has grossly misconceived the idea of exercising his Right to Information as being absolute and unconditional. In view of the above, there is a pressing need to identify cases such as the ones under adjudication for cumulative disposal in order to facilitate expedient disposal of cases of other information seekers. In other words, where such juxtaposition comes into play, the Commission seeks to strike a fine balance between the interests of information seekers at large, while keeping the menace of frivolous and repetitive RTI Applicants under check.
Page 36 of 38In all of the above Appeals/Complaints, the Appellant has sought information relating to action taken on his complaints filed before the Respondent public authority regarding alleged illegal construction on separate properties situated in the City-S.P. Zone. It is noted that while the PIO has supplied available information and has also complied with the directions of their First Appellate Authority. While the queries raised by the Appellant indicate his attempt to raise awareness about the menace of illegal unauthorized constructions in the city, the Commission cannot encourage the means adopted by the appellant, of filing multiple RTI applications. The approach of the FAA while handling the First Appeals is also rather mechanical, indicating lack of application of mind.
In view of this, the Commission finds it pivotal to highlight a recent decision of this bench, wherein aspect of "misuse of the right to information Act by the Appellant" has been explained in a manner. In this regard, ratio laid down in the matter of Nandkishor Gupta v. CPIO, Northwestern Railway, Head Quarter Office, Malviya Nagar, Jaipur - 302017. The relevant portion of the said judgment is as under:
"The Appellant being a serving employee of the respondent Public Authority has as much right to information as is available to any other citizen of India. However, such a serving employee has an added obligation to frame the request in simplest and most easily understood form possible because he/she knows the circumstances under which his/her colleagues are working while also discharging the additional duty as CPIO and FAA. Therefore, the conduct of the Appellant in the present matter, to say the least, is questionable and is not appreciated.
Accordingly, the appellant is cautioned and admonished wherein he should keep in mind that the RTI Act should be used judiciously, sensibly and responsibly so that purpose of the RTI Act would not be defeated. The Commission leaves it to the concerned disciplinary authority for any consequent action in the matter. "
The Complainant has not been judicious in the use of RTI Act and has been using it as a tool to harass the Public Authority. The Complainant is therefore cautioned to exercise his right to information in an informed and judicious manner."
In view of the above, the Commission does not intend to encourage the means adopted by the Appellant by filing repetitive similar RTI Applications which is against the spirit of RTI Act and clogging the valuable time and resources of the Public Authorities. In this regard, the Commission invites attention of the Page 37 of 38 parties towards a judgement of the Hon'ble High Court of Kolkata in a case titled Biplab Kumar Chowdhury v. The State of West Bengal & Ors. WPA 3116 of 2022 wherein it was held as under -
"...It appears from the documents annexed to the writ petition that the petitioner's ploy is to collect information under the Right to Information Act and thereafter use the said information to harass the private parties as well as the Municipality for unlawful gain. The conduct of the petitioner appears to be plainly harrassive and mala fide.
The averments and allegations made in the writ petition remains unsubstantiated. The writ petition is an abuse of the process of law and liable to be dismissed with costs.
The writ petition is accordingly dismissed with costs of Rs. 25,000/-(twenty- five thousand) only to be paid by the petitioner in the office of the West Bengal State Legal Services Authority within September 30, 2022..."
The Commission finds no mala fide on part of the PIOs. Further, the Commission, like on several occasions in the past, again advises the Complainant/Appellant to make judicious and sensible use of his Right to Information Act in future instead of making it as a tool to create undue pressure on the Public Authority.
The above cases are disposed off accordingly.
